Dear All,

I am thinking of applying Tier - 1 HSMP Visa. I have worked in USA past 18 months. After I came back to India and took leave one month. (Loss of Pay).

Now I have got another opportunity in India. My doubts are .

Do I need to produce current my Indian offer letter as well pay-stubs?

I heard that, there will be chances of getting rejection, if we produce 2 country pay stubs?

I have only US pay stubs more than 18 months, only thing is current job is Indian job and I am showing investment proof also in USD's

you can show as many jobs as you like but they should all be for 12 months or under and within last 15 months before the date of your application

2. I have UG english medium certificate.
3. All original mark sheets.
4. Bank statements.

Can you please sugest me step by step process to make this work smooth and go positive?

Again, the maximum you can show is 12 months and that too within the last 15 months.
try Points Based Calculator to check if you're eligible and go through the policy guidance

So, I am getting enough marks but

I am planning to submit my paystubs from last Jan 2009 to Till May 2010. As now it's July and I didnt worked in July came to India on Loss of pay.. will it create some problem?

As iD explained you have to show payslips for 12 continuous months in the 15 month cycle preceding your application date. Based on this, you can plan regarding the exclusion of July Pay.

I would suggest a reading of Tier-1 guidance (it's available at UKBA Website). It is the guiding document.

Sorry, please ignore my earlier post.

I have calculated wrong. I am getting just 70 points in Appendix A .

My Date of birth as per certificate : 01-July-1980, do they calculate 29 years or 30 years? for this?

Also I came to India in 1st week of June . So I didnt get pay for the month of June. But before that I was having all paystubs more than 15 months.

Before 3 years my Indian salary 7.5 lacks, with that I was getting 35 marks now, I am just getting 25 marks with 62000 USD's. Can some one sugest to over come this issue?

If it is 70 points, you may not be eligible.

Age is considered to be the years completed at the time of application or fees paid whichever is earlier. (As on today you would be 29 years)

The rule is very clear. Earnings upto 15 months before the date of application for a continuous period of 12 months (can be less also if you managed to get points with a lesser period)

It must have been due to Rule change. We should not compare Apples with Oranges.

I do not have new rules guidance. Kindly check from your end. It is easily downloaded (around 600 KB). It will be handy reference.

You might get 10 points for age as this is your initial application. Under extension you get 20 points for age <30. You need to check the latest rules.

Yes you will get 20 points if you apply before 01July

And now I have got into one more problem.

Funds Maintenance :

I have kept my bank balance in March 3200 - 4200 USD . It was varying every day. It's not equal to 2800 GBP. Can you sugest me in this ?

I have more funds from April 27th but from March 29th it was varying. from 4300 - 3200 usd. If I wait one more month my age will be a problem. Can you sugest me please

You can show maintenance with a combination of accounts on your name. If you have money in any other accounts, you can show them along with this.

I dont have any other account balances :( do you think can I manage some how? on avg I get more . but if they see daily basis I will be in less amount.

Sorry my friend. Maintenance fund is not looked at on average. You must have the minimum fund each and every day for the stipulated 90 day period.

Cannot suggest how to increase your income. Pls go through the policy guidance and check if you have any income that can be shown along with your salary.

123. Earnings may include, among other things:
• salaries (includes full-time, part-time, and bonuses);
• earnings from self-employment;
• earnings from business activities;
• statutory maternity pay and contractual maternity pay;
• allowances (such as accommodation, schooling or car allowances) that form part of an applicant’s remuneration package;
• dividends paid by a company in which the applicant is active in the day-to-day management, or where the applicant receives the dividend as part or all of his/her remuneration package;
• income from property rental, where this forms part of the applicant’s business; and
• payment in lieu of notice (a payment made instead of requiring an employee to work the normal period of notice when leaving a job).

I had one ICICI - Prudential insurance bond which costs around 1 lack indian rupees. It's matured almost 6 months before, if I get letter from bank saying that " This fund can be withdrawn anytime so and so date" this will be useful?

Also if yes and apply and in case any rejection happens will it create any problem future HSMP Visa's????
