Is 180 Days Rule applicable for dependent daughter over 18 ?

Post by vijayb » Wed Jun 23, 2010 5:45 pm

Hi

1.I applied for HSMP on 28-Nov-2005 from India.
2.I received refusal letter dated 04-April-2006 from Home Office.
3.I made appeal request on 22-April-2006 to review my HSMP application.
4.I was successful and I received HSMP approval letter dated 25-May-2006 from Home Office.
5.I applied for Entry Clearance from India and got Entry Clearance to UK under HSMP for initial two years period from 31-July-2006 to 31-July-2008.
6.I searched for jobs in UK from India and on receiving a firm job offer I entered UK on 28-Jan-2007.
7.I applied for visa extension at the end of my initial 2 year period on 30-Jul-2008 and got Tier1 for another three years from 20-Aug-2008 to 20-Aug-2011.

I will apply for ILR in Jan-2011 after completion of my four years stay in UK based on HSMP (JR) and my original HSMP application date (28-Nov-2005) which was before 03-April-2006.

I have one daughter who is now 18 years old and I will also submit her separate ILR application along with our (me & wife) application. My wife & daughter are dependent on me. My daughter had been out of UK during her school/ Univ. holidays. Does she also need to be out of UK for not more than 180 days ?

Could you please advise me if the '180 days rule' is also applicable to her.

Thank you.

Vijay

NO. The 180/90 rule is for the main applicant only, dependants just follow your status.

Hello Vijay B,
This is not related to your querry but I need one information from you. Does your daughter go to Uni in UK. If yes do you pay home fee or Internation student fee without having an ILR? My daughter is going to Uni this year and I also don't have ILR so this will be great help.
