Child born to Indian parents on ILR

Post by mammamia » Wed Dec 22, 2010 1:26 pm

We got our ILR in Jan 2010, and our child was born in AUgust - can she apply for British passport automatically or has she got to apply thro form MN1... any advice appreciated

We have a wedding to attend - and just realised that our child has an Indian passport - no visas yet on the passport
Have to travel in the next 6 weeks - and thought the quickest way would be to get the british passport and an indian visa for the child alone... any ideas to a better quicker way ?

appreciate any aadvice

Thanks

If baby was born in the UK, then baby is automatically a British citizen. A British citizen may apply for a British passport.

If baby was born in the UK to a british citizens/settled person, then baby is automatically a British citizen. A British citizen may apply for a British passport.

if someone was on wp while the baby was born ...once they get ILR they need to register the baby as "British Citizen" using MN1

my baby born while I was on HSMP and I am eligible for ILR in October 2011.
1. I am planning to make ILR application only for myself and wife.
2. Then register baby as 'British Citizen' using MN1 form
3. then apply for British passport for baby.

But we need to visit India in November 2011 and I think it is highly unlikely with the timeframes of MN1 and passport application. Does anyway one know how long it will take for MN1 processing and british passport processing?

If not the only other option for me is to apply for Indian passport or any other quicker ways.
Pls suggest

Hi KCK9,

You have to go through the following steps

1. Apply for MN1 for getting British registration certificate (roughly a month)
2. Apply for passport (1 week premium application)
3. Obtain a surrender certificate (if your daughter has an Indian passport) by giving up Indian nationality
4. Apply for PEO or getting a Indian Visa to go to India.

I am not sure about the timeline for the steps 3 through 4.

Thank you for your reply BSK.

So applying for British Citizen via MN1 only takes 1 month????

I heard few people saying that it will take 2-3 months. I was little confused when I saw that.

BSK, is there anyway that I can register baby as British Citizen (MN1) from India.
