Hello friends,

Hope you all are doing good!

I wanted to know the current rules for extension on Tier 2 (ICT). I checked on the Home Office website and found the following information:

Category: Short-term staff Inside the UK

You can apply for the period of time you need to take your total stay in the UK in this sub-category to 12 months, or the period given on your certificate of sponsorship plus 1 month, whichever is shorter (beginning no more than 14 days before the start date given on your certificate of sponsorship).

Please explain what does this mean...

Does this mean that:

1) If I want to apply for my extension after my visa expires, will I only be able to extend for a total of 12 months henceforth? or
2) I'll be able to extend my visa for any time period till my company needs me here?

Please note that I have been in UK from before April' 2010.

This rule is really confusing me... Could you please explain more about this.

My WP dates are...29-May-2011 to 28-May-2012.

Is it possible to extend after this time?

(a) if the applicant is applying for leave to remain as a Tier 2 (Intra-Company Transfer) Migrant in either the Short Term Staff or Graduate Trainee sub-categories, leave to remain will be granted for:

(i) the length of the period of engagement plus 14 days, or

(ii) the difference between the period of leave that the applicant has already been granted, beginning with his last grant of entry clearance as a Tier 2 (Intra-Company Transfer) Migrant, and 12 months,

whichever is the shorter. If the calculation of period of leave comes to zero or a negative number, leave to remain will be refused.

what is your current visa category under Tier 2 ICT?

The minimum salary for Long Term Staff is £40k. If you are on much less than that then your employer may not want to bring you back in that category.

Am I eligible to apply Tier2 General category when I am in Tier2 ICT Short term in UK?

Tier 2 ICT cannot apply within UK for Tier 2 General. You will have to find yourself an employer who will issue you a restricted COS to allow you to apply for Tier 2 General from your home country.

Hello,

Sorry to jump on your post.

I am Tier 2 general Visa from 4th Jan 2013 which got expired on 15th jan 2016. My new visa is from 21st Jan 2016 valid until 10th jan 2019.

Now I have a question while applying for ILR in Jan 2018 (i will complete 5 years in this country on tier 2 visa) will the gap of 1 week i.e; from 16th jan 2016 to 20th jan 2016 will cause any problem. I mean will be eligible for ilr or not.
