Hello Guys,

Hope you are doing well.

I am about to send my ILR application. I have some debt from credit cards and loans and its around £20K, but I am paying them back regularly through the debt management plan via agency. There is no CCJ against me from any of creditors.

I am wondering, would it make any effect on my ILR application ????? I would appreciate if any of you response me please.

hi guys i just received refusal letter , stating that because i had no visa 2003 - 2004 and that was because i lost my passport and was unable to extend my visa , i did let UKBA know at the time , what should i do now?

i have student visa till end of October12.

when did you apply?

I applied 20th April , they stated we understand that you lost your passport but you failed to meet 10 years lawfully residency , I did write UKBA letter explaining what happened back in 2003 and they replied that when ever you have the new passport send it to us , it took me 6 month to get new passport .

Can you please give use more details to have any chance of helping you.

1) Did your visa expire between 2003 and 2004? If so what was the date of expiry?

2) Which date was your passport reported missing to police?
3) Which date was your passport reported missing to UKBA?
4) Which date was your new passport issued?
5) Which date was was your new visa issued in 2004?

Without all these details no one can give you proper advice.

My visa expired end of August 2003

My passport lost 20Th August
police report 20th August

letter wrote 21th August attached with police report and underground police report

my new passport issued Jan 2004

and new visa issued 20th Feb 2004.

Ok. It looks like you have done everything you could and I cannot see any fault of yours.

But with your ILR application did you attach any of the following?

1) Police report
2) Proof of application date from relevant embassy for new passport
3) Acknowledgement from UKBA for the lost passport

i LOST THE ACKNOWLEDGE LETTER FROM UKBA , BUT I SENT A PAPER THAT DID MENTION THE NAME OF PERSON WHO WROTE BACK TO ME .

APPLICATION MADE AT EMBASSY FOR NEW PASSPORT NO I DID NOT SEND BUT I MENTIONED IN MY COVERING LETTER THAT I APPLIED FOR NEW PASSPORT 02/09/2003 .

I DID SEND THE POLICE REPORT AND COPY OF LETTER I SENT AT THE TIME

Any particular reason why you waited 10 days before you applied for the new passport?

Ok I dont think you are at any fault here. I think you should be able get your ILR with some professional advice. The home office should be able to use discretion and grant you ILR. You may also be able to contact your MP about this.

Hopefully user "Jon336" can be kind enough and help you with details of his solicitor and how he went about with his appeal process.

Hi there, am sorry to hear that, when ur visa was about to run out u were meant to go ahead and apply for ur visa extension andwhile u r waiting for ur visa to b considerd u should be applying for ur new passport and send it immediatley u get it to the home office. But since u waited,that's the mistake u did. Its sad I know, but that's the way home officework, but just look for a good solicitor who can help u , good luck mate, God Bless

Entered in Britain 03 October 2003

Leave valid 24 August 2013

Can he apply long residence or does he need to apply extension in some other category to bridge this gap (24 August 2013 – 03 October 2013) ?

But if I did send any application with no passport it would come back to me as invalid , and when I write to UKBA I wasn't advised to make application. ...

Technically yes, you need to apply for some sort of visa to fill the gap but then one of my friend was in the same situation and his solicitor helped him out with a very good covering letter. but then this was a couple of years ago. things might've changed a lot from a case worker's perspective...So I'd suggest you to seek advice from a professional Immigration lawyer..but then its only my personal opinion....HTH

BTW he did had a suggestion donno if its worth trying...but you can apply for a Student visa and hope for the HO to make a decision delayed for atleast a month or so and then make an application on Long Residence by withdrawing your student application and asking them to forward your passport to the relevant ILR dept...

I have applied SET (O)10 years long residence for myself and FLR (M) for my wife & children at the same time. I have sent both applications at the same SET (O) address requesting them to make decision on my application first and then go to others as other applications are based on mine.

My timeline is
Application sent : 24/08/12 (Fri)
Application received by HO :28/08/12 (Tue) Due to Bank Hol
payment taken out : Waiting
Acknowledgement letter : Waiting
Biometric letter :waiting
biometric done : waiting
passport/bio card received : waiting

The countdown starts now...hopefully I will get a relief once it’s done….

HI, No my friend, i did that in 2009 i lost my passport and i applied without even calling ukba.On their forms since 2003 forms there has been an option where u can tell them if u dont have ur passport.

Am sure there was a mis understanding somewhere becoz the ukba should have told u to go ahead with the application then u send them the passoprt once u get it.Application cannot be deemed invalid if u explain to them what happend to ur passport.Anyone can loose their passport mate ..U need then to get a good solicitor..Wish u luck mate..God less.

not sure how to start new topic so here is waht i found out today

its been 6 months today for my application i posted mine on 15th march ( today is completion of 24 weeks) they said its 6 calander months so i can call them only after 15th sep and they can acess my file untill than they cannot say anything...

I sent my application to the Durham ILR on 22/08/12 and still have not received an acknowledgement letter of my application being received by Home Office. Payment has not been taken either. I wondered if the delay is due to the long Bank Holiday weekend in my case?

Probably. 2 of my friend send the applicaition one is on 18th received acknowledgement on 25th. anothe one on 6th havent received acknowledgement but money was taken on 24th. so its look like there is 2/3 week processing time for sending acknowledgement and money collection.
