FLR Application - Uncertainty about student visa

Hello evryone, was feeling worried about my situation and decided to seek your assistance

I graduated with a Bachelors in Software Engineering from a British university AND subsequently went on to read a second degree ( Masters in Computing), in another British university.

Unfortunately during my Masters degree, I ran into some financial problems, was unable to pay my tuition fees and decided to seek a full time job i.e. I quit my Masters.

Luckily, I was offered a full time vacancy and my Work Permit has already been APPROVED. I am now in the process of Applying for FLR(IED).

My question is:

-Will my FLR IED application get approved if I used my first degree (Bachelors) in my FLR application ? Currently I am on a student visa which was issued for my Masters degree. (The criteria on the Home Office website states that i may switch status from student to WP holder provided that I have a degree from a British university.)

I am obviously unable to use my Masters degree in my FLR(IED) application because I quit and did not finish it completely.

As you long as you have remained on a student visa since your degree was awarded then you will meet the switching criteria.

Yes, I have remained on my student visa for my Masters (caveat: this visa was extended from the initial student visa issued for my Bachelors which i succesfully completed and graduated)

Would this mean I still qualify for switching ? How sure are you ?

Apologies for the barrage of questions. I am a little worried about my situation. :(

If your current stay here is covered under a valid visa, then I do not see any problem at the time of your student visa to WP-FLR switch.
Its going to be fine so there is no need to panic unnecessarily.

One thing to bear in mind here...
If you are on a student visa you must have been studying all the period the visa was issued for.
If you quit your Masters course and never got your masters degree you ceased to be a student and if you remained in the UK after that, you were technically in breach of the immigration rules.
I do not want to frighten you but if the IND are aware of your quitting the course your switching application will be denied.

I have recently read one AIT determination where an appellant applied to switch from student into spouse of a British citizen. He came to the UK on the student visa but quit half way, started working full time, then met someone here holding British citizenship and got married. At the end of his student visa, he applied to remain as a spouse but his switching application had been denied by the IND. He appealed. His appeal was dismissed and he was compelled to leave the UK and apply for entry clearance as a spouse from abroad and return.
The IND found out (how I don't know) that he stopped studying and was working. They found that he remained in breach of the rules although within his student visa but having ceased to be a student. They refused his application to remain as a spouse even he met all the rules except one paragraph that states that he must not have remained in the UK in breach of the immigration rules but he did. The AIT upheld the IND's decision.

As I am saying, God forbid you come across the problem like this, but just bear in mind that in principle, you may encounter such situation, especially if your university reported you to the IND that you had quit your studies.

Sounds interesting.

Although in my situation, I have succesfully graduated my Bachelors with my initial student visa and had merely extended this student visa for my Masters, which I didn't manage to complete.

Now, I also posted on another forum (www.ukresident.com) and the reply I got for an 'in the know' member was that my FLR(IED) application would get REJECTED.

As you may recall I have already graduated successfully with a Bachelors degree from a British University before my Masters. I had merely extended my student visa (issued initially for my Bachelors) to undertake my Masters, which I had to leave abruptly due to financial contraints. Then I got issued with a Work Permit

I was wondering that if she is definitely positive on this one?

I have a bad feeeling about this.

Why don't you just wait like an adult and see what you get in the end?!
You cannot change what you have applied for and you have no control on what will happen.

Why don't you just pluck up your spirits and wait?? Then you will see what to do next...

I posted a reply to this on ukresident.com as well. I am in EXACTLY the same situation as you rford and would appreciate it if you could tell me the outcome of your FLR. I havent exactly quit my masters.. Im just having a lot of problems with the uni and my supervisor so its very much stalled. I have my work permit approved and about to apply for the FLR through my solicitors. She seems to think itll be fine, but as we know the kind lawyer on ukresident.com does not seem too confident. My lawyer is charging a lot of money for the flr so I am wondering what i should do. Ill definalty apply for it, but worried about my chances. More sleepless nights..

let me know how you get on please, and anyone else in the know who reads this.. any advice is MOST appreciated.

Zeddie,

Thanks for sharing. I'm assuming that previously you have had a minimum of a Bachelors for an accreditated British uni and you'd merely renewed your visa issued for your Bachelors for your current Masters and that there are no gaps in between this student visa?

My application is still pending. Funny how people are divided into 2 different camps on this !

What is your solicitor's argument that she's thinks it will be fine? (hope her confidence is not inflated purely because of the £££)

Hi again.

Firstly, yes i finished my Bsc here and did my Msc at the same uni. My Msc is sill ongoing, as i havent exactly quit it. But having so many problems with the uni, i might just leave if i get the FLR approved for the WP.

I only got my work permit approval yesterday, and my lawyer is applyig for the FLR. She does seem very confident i will get it, and her reasoning on the phone today was "i have done this many many times with people in your situation, leave it to me and i garuntee you will get your FLR" Now that does seem condifent doesnt it? :S

Im worried about something else though. In the application you have to enclose a lot of documents, 1 being your 3 months of bank statements. I have always had a savings accound and a current account. My current account for the last few months has been on the overdraft (within its limits) due to lawyers fees etc and ive always transfered money (little amounts) from my savings account. The savings account has about 3.5K in it.

Im just worried that they will say something becuase of the overdraft. Are they likely to query that or will they look at the savings account as well and let it go. As i said the savings account has about 3.5k in it an the current is od by around 1300 (limit is 1600). How much are they looking for? What do they need to see in the statements..

Anyone have any ideas/suggestions.. It would be most appreciated.
