UKBA keeping documents

Hi all,
I was refused a visa because of 37.5 vs. 40 hours issue. After this I haven't received my documents back yet. I am on the stage of appeal because my employer made a typing error while issuing CoS, but now all is ready for re-application.
My visa expired October 2012 (I applied on time), I am switching from Tier 4 -> Tier 2.
The question is - if I apply again with new documents (CoS) how can I get my documents back? and do I need to? While I have active appeal.
