GAP ISN'T ?????

Dear All,

I came to UK on 11 JAN 2004. I am applying for ILR under 10 year rule before the end of January 2014 (my current leave runs out on 16 March 2016 HSMP tier 1 GENERAL).

I have received my SAR file today from Home Office. All the data seems to be in order, except for 1 thing.

During 2008, my visa was expiring on 31st March 2008 (student Visa and applied for extension). Home office received my application on 26 March 2008.

I forgot to fill the section on forms from 7.2 to7.6 which were mandatory. As a result in the SAR documents I received I can see on 14 April 2008 my case was rejected and it has notes/minutes saying .. Application not completed section 7.2 to7.6 are mandatory, there fore application rejected and returned all documents including passport and other supporting documents. Dated 14 April

I received the returned documents along with a letter next day by filling the section from 7.2 to 7.6 according to SAR home office received my documents again on 16 April 2008.

In the SAR file I can see a decision made on 10th May 2008 and they granted me visa until 31st October 2009
What concerns me and why I have told you this whole story is the following:
1- In the SAR in case record sheet for the date 10th May 2008 when the leave to remain was granted, there is a note saying "previous application rejected"
Question: Given the circumstances above, is it safe to assume, a gap has occurred and the ILR clock has been reset in 2008?
Can this argument be used to say that, actually the ILR clock has not been broken?
I have seven time visa extension and all time applications were made on time except this rejection mentioned above though it was submitted on time too.

Hello Everyone,

I just need to know what is the time scale once you have had your Biometric done?? Do the HO call you or contact you after the Biometric is been done, as I was told at the Post office that HO will contact you.

Anyone who are experienced can throw some light , would be appreciated.

wife's FLR M application

Hi,

As I am happy with my ILR, I now have to inform UKBA to process my wife's FLR M. I sent her application just one week after I sent my SET LR.

Should I now just call UKBA or send a letter with all references of my wife's case and mine.

I already got an answers to my questions by you, However I was interested in checking the above link you gave it to Amina11 and found that as my wife entered the UK in 2005 as a student and student to date,

According to my understanding she/me doesn't need to show any funds as she falling into on or before 8 July category when she'll be applying for FLR(M)- she'll be my dependant for the first time.


I entered the UK as a student in September 2003, had been my wife's T4 dependant since 2007 and applied for ILR under long residence route in August 2013.

Please be kind enough to clarify our situation.

Dear Yasir as far i understand from your story you are fine and can apply under 10 years rule because you applied before the Expiry of your leave which was 31st of March so from this date till HO made decision that your application is not completed so its rejected/invalid you were covered under section 3c then from the date you received notification that your application is invalid/rejected you were granted leave less then 28 days as per new rules if you have gap not more then 28 days your continuous residence has been maintained

Unfortunately, your wife was not subject to the transitional provisions. E-ILRP.1.3 prevents her earlier leave to be aggregated.

Your wife will be subject to the new rules since she is not currently here as your dependent. If she applies for leave as your spouse on form FLR(M) you will need to meet the new income requirements and she will need to complete 5 years as your spouse in order to qualify for ILR through this route or she may qualify for 10 Yr LR Route in her own right in 2015.

By the grace of Allah I got my ilr (lr) this morning.
Mine was a quite a complicated case.

In summary
I completed 10 years from 1997-2007 then I left the uk for 18 months and came back on tier 1 visa. I was told I would not be able to apply under the 10 year rule as I had a gap of more than 3 months. I called a few solicitors up most said I was not able to apply only 2 said I was. So I joined this forum and all the experts said I was eligible as once you complete the 10 years u can apply any time.
Then I had a criminal record back in 2002 for which I got a non custodial sentence.
Further to this a few exit and entry dates on my passport were in a arabic and they had been faded to the point of it being unreadable ( for this in the covering letter i told them They were approximate dates)

The time line

JuLy 25 Application sent set LR
30th JUly biometric letter
5th aug biometrics submitted
29th Nov ilr letter and passport given back.

Documents submitted
Passport
Tier 1 biometric card
Bank statements
Covering letter

I would like to thank all the members of this forum for all their useful input and their patience especially when answering silly questions and repeat questions just worded differently and even questions like I have a friend who.... ;)

If there are any questions I will try to answer them as best as I can

Hello Guys

Any more October applicants got bio invite yet. I've been waiting for nearly 36 days to get a biometric letter. The bank can't say if the draft has been cashed. I had an acknowledgement letter 3 weeks ago. HO says your payment must have been ok for you to get an acknowledgement letter, they also said drafts are generally fine. All they say is the application is not updated on the system yet, maybe it's just waiting to be updated. What I find shocking is there is no way for them to find out where your application is or ask someone why it hasn't been uploaded on the system. Yet they can locate if you are withdrawing your application. So fishy this department, I'm not at all surprised the MP's lambast their record of service on a routine basis.

I know one member here "Abchardik" who applied in October and recently got his biometric letter. Any other applicants????
