Many thanks for your reply. I called UKBA the other day and was told to just write down the dates in the form without sending any tickets etc.

Hello arashmg,
i would advise you to submit your e-tickets together with your application to prove to the CW the actual dates you traveled out of the country, although if your out-of-country absences does not exceed the required days stipulated on the guidance then you are fine. I do not think you are required to translate the dates .

Hi Guys,

I have applied my ILR (10 year) on sep 28. I am still waiting for my approval. I hopping that to be approve that soon.

I am in the process applying FLR (M) for my wife once they grant my ILR. She is currently on TIer 1 dependant since Oct 2010. Our child is also tier 1 dependant visa since June 2012. He was born in India.

Now my questions are:

1) I believe I have to fill in FLR (M) for my wife. What visa form is for my child since he was born in India? I have recently seen changes in the form. I dont know what is the purpose of FLR (FP) form?

2) My wife has got MBA from India. I can see her university on PBS calculator. Do we still have to get UK NARIC certificate for English language criteria?? Is the evidence of PBS calculator is enough to meet English Language criteria.

3) She is in UK Since Oct 2010. I believe she will be able to apply SET(M) once FLR(M) approves since she has already spent 2 years in UK. However, she was away to India from Nov 2011 to Sep 2012 for pregnancy.

Please advise.

Just been on the phone to HO and they are still processing August.
For the last 7 weeks they have been processing August.
How many applications were made in August ?

My ILR application was refused.
Time line:
Application Sent: 28 August 2003
Biometric: 16 Sept 2003
Refusal letter: 02 January 2014

My first entry visa was valid from 1 Sept 2003 to 31 Oct 2004. I applied for renewal on 30th Oct 2004 (a day before expiration) which was granted on 9 Dec 2004.

The only reason for refusal was that I submitted out of time application which wasn't actually the case. The visa on my passport clearly shows 31 Oct as the expiry date but the case worker didn't bother to check my visa page and just assumed that the visa expired on 1 Oct 2003!

Has anyone experienced this kind of mistake from HO?

I will appreciate any advice on how to get this resolve. HO email addresses, phone numbers etc will be appreciated.

Could you clarify a few things please, as it wasn't immediately clear from your post-

1) Did the Home Office specifically state that you have been refused on the basis of an out of time application? and if so did they particularly state the first renewal that you mentioned above in your post?

2) You say the case worker assumed your visa expired on 1st Oct 2003, is that a typo.. assume you meant 1st Oct 2004?

3) Did you apply for a SAR file before your submitted your visa application?

4) What was your visa history? ie Student visa, PSW visa, Tier 1/2 visa etc

1. It is not a typo, HO specifically stated that I was refused based on out of time application (30 days). The refusal letter stated that my visa expired on 1 Oct 2004 whereas the expiry date on my passport was 31 Oct 2004. I just don't know where they found 1 Oct.

2. I did not apply for SAR before submission

3. 5 years student; 2 years PSW, 3 years Tier 2 General (expires in 2016 -renewed a month before ILR application)

Thanks of Almighty Allah, I got approval of my ILR. I received my all Passports, LIUK and approval letter (Dated:04 Jan 2014); I am wondered about the day on 04 Jan 14 (Saturday); Is Home office work on Saturday? Home office disregard 28 days and by mistaken case worker thought it is 30days therefore your visa was refused.You must have got right of appeal but I would suggest you chase the case by involving your MP as this will speed up your case. This is just what I think and try to do quicker if you got right of appeal it will be ten days only do it within that time.
