QUALIFIED PERSON FOR EEA2 APPLICATION

I am thinking of applying for eea2, as my cousin brother is an EE citizen. He has been living here for more than four years. First two and half years he worked in east London based company. Later he had a sudden heart attack, which resulted his losing the job. His doctor prescribed him not to take another job, as he is not fit yet. Last year he had to claim for employment and support allowance. It has been now one and half year he is not working, and taking employment and support allowance.

He is settled here. He has got eea1 registration card. But If I want to apply as his extended family member. I have to prove he is a qualified worker according to article 6 (1) . he is not working currently due to sickness. Could you please tell me, would he be considered as a qualified worker or not. I found in Eea regulations 6 ( 2 )(a), A person who is no longer working shall not cease to be treated as a worker for the purpose of paragraph (1)(b) if
(a ) he is temporarily unable to work as the result of an illness or accident;

I need the information, desperately searching around :? :x , did not get answer yet.
Please advise .

What do you mean by 'cousin brother'??

I think you also have to prove that you were and are dependent on him and previously and currently part of his residence. From your previous posts, you have a wife and child and have submitted an FLR(FP) application?

@miakabir7 : I just checked your previous posts and I gathered that :
You have a wife and child
You have a pending FLR FP application


Now , Let me ask you this :
are you , Your wife and your child all dependant on your cousin ?
(the cousin who is not working atm ? )

I'll be honest , IMHO , I think the application will fail .
