Question about calculating absences

Post by arminkhan » Tue Jun 27, 2023 5:47 pm

With thanks and appreciation we need your instructions on this
OUR CARD ISSUED DATE IS 04.08.2020
OUR FIRST ENTRY IS 31.08.2020
EXPIRY DATE IS 18.08.2023
My question is the absence calculation for the 12 month period is which one of these below formulas based on ?
FIRST FORMULA
From the date of ILR Application and back to last 12 months before this date?
Then the same another 12 months as second year and another 12 months as the first year .
For Example if we apply 31 July 2023 ( starting from 31 July 2023 till 31 July 2022 ) As Third year
and ( starting 31 July 2022 till 31 July 2021 ) As second year
and ( starting 31 July 2021 till 31 July 2020 ) as first year .
SECOND FORMULA
From the Date of first Entrance date every 12 months? as our first landing date is 31 Aug 2020 means three blocks of 12 months after the landing date ?
Also for more clarification kindly i would like to fix a virtual appointment pls.

Useful to state what visa route you are on. Presumably you are on Skilled Worker visa?

The absence limit is no more than 180 days in ANY 12 month rolling period. It is not based on your date of entry or the date you apply for ILR or a calendar year. It is ANY 12 month period.

You need to contact a lawyer or immigration advisor if you need a 'virtual appointment'. The forum is only a place for people to post their questions and get help from the unpaid volunteers who can advise of the different immigration categories. We are not lawyers or immigration advisors.
