ILR getting closer, few queries?

Post by tier21419 » Mon Jan 07, 2019 3:02 pm

I was granted my first tier 2 visa from 27-03-2014 until 19-05-2017. I was on Doctoral extension scheme (DES) before that, therefore was exempt from RLMT. The start and end dates on CoS were 01/05/2014 – 01/05/2017.
First question: As I was issued Tier 2 visa before my starting date, my understanding is I will qualify for ILR 28 days before 27-03-2014. Is this right?
Please note that I was working with the same the employer when I was on DES.
Before my first tier-2 visa expired, I was promoted to Research Fellow (right after my previous contract was finishing i.e. on 02/05/2017) from Research Associate (both roles have same SoC Code) and pay was raised from lets say 33000 to 40000. I applied for my tier-2 visa extension and got my visa untill Dec-2019. The change of promotion was reported to UKVI on 02/03/2017 about my job title, description and salary with effect from 2 May 2017 under my first CoS.
Second Question: Do you see this raise an issue and the way it was done an issue? Please note that my job is a PhD level job and I am exempt from salary requirement for ILR.
Also, there was no RMLT as this was extension within the same SoC Code. This is OK, right?
I might be overthinking but wanted to get confirmation.
Thanks
W

For ILR only the visa issue date matters. The raise / salary should not be an issue

Thanks, Zimba. So I am good to go for ILR (SET(O)) after 27/03/2019 - 28 days?

Question regarding upcoming ILR application after tier2

Post by tier21419 » Sat Feb 23, 2019 9:55 pm

Hello,
I have a few questions regarding my upcoming ILR application.
1. My initial tier 2 visa was issued on 27/03/2014 (date on my BRP), so I believe I will be eligible to apply for ILR from 01/03/2019 (or precisely 28/02/2019), correct?
2. This (01/03/2019) should be the date when I submit the online form, right?
3. As my employer has to give a letter to show my absences and where I travelled. I was wondering how they should mention if I attended a meeting in France but I took flights to and from Switzerland? The stamps on my passport are by Swiss Authorities but the meeting was in France?
4. I have to use SET(O) form, right?
5. I get bank statement on 28th of every month. Lets say I get my bank statement on 28/02/2019, this statement will have my salary for January on 31/01/2019, and if I get biometric appointment on 20/03/2019, will this statement be OK or shall I request another one with February salary?
6. Is there any other requirement that I might be missing e.g. I should have been in the UK last year on the same day? or anything else?
7.  I believe Pakistani national does not need Police registration form, am I right?
8. I am planning to submit following documents, are these correct and anything else needed?
- Current passport (including scans of all pages)
- BRP
- Signed consent form (for Home Office to do verification checks)
- Life in the UK Tess pass notification
- UK Degree certificates (for language requirement)
- Employer Letter confirming my employment status (key words "still needed for the foreseeable future", my current salary, the SOC (the same was on my Tier 2 CoS), and my salary is above the required rate)
- Payslip (3 months) also letter from HR to certify that these are genuine
- Bank statement (1 or 3 months)
- Employer Letter confirming my absences from the UK (shall they also confirm how many days of annual leave I'm entitled to?)
- Police report for previous lost passport, however this passport was before my first tier 2 visa was granted.
Any other documents?

Many thanks.

Thanks, Zimba. A couple of more questions;

I was once stopped by the immigration officer at the Heathrow Airport on my return from a meeting. She handed me a letter and asked me to take a seat. She went away to make some checks. She came back after 10-15 minutes and let me go (I think she mentioned that there was some confusion). Is this something to worried about and do I have to mention this any where on the form?

Also, in 2017, I received a Traffic Penalty charge notice (50L) performing prohibited turn, which I paid on time. Do I have to mention this any where?

Thanks

Post by tier21419 » Tue Feb 26, 2019 5:38 pm

Many thanks, All. A couple of more question, please.
1) There is a question "When did you first enter the UK". I have answered this as the date I was first granted with a tier 2 visa. I hope this is right? Please note, I was on post doctoral extension scheme before that.
is the first tier 2 visa issue date correct in this case?
2) While entering time spent outside the UK, I went to attend a conference in France. However, I traveled through a Swiss Airport. I have entered France as country with dates but in the details section, I have mentioned that i have used a Swiss airport. This is to avoid confusion as my passport has Swiss stamps. Is this a correct way of doing this or any other options?
3) For documents, what I have to provide for 'Evidence of Mr ABC's immigration status in the UK"?
4) For documents, what I have to provide for 'For the period before you were granted leave as a Tier 2 migrant, documents showing that you met the relevant requirements of the immigration rules. For further information concerning the evidence required, please refer to the Tier 2 migrant policy guidance on our website'?
5) Regarding consent forms. I believe I have to sign Part 1 only. Part 2 is for third party information, I am not submitting any joint account documents so I don’t think this is needed. Part 3 is for third party sponsor. No one is financially sponsoring me, so I can leave this as well? Or is it for my sponsor?
Am I right in saying that I only have to sign part 1?

Many thanks.

1. No, it is day day you enter UK after the grant of your visa, not the date of grant of visa. I am sure the stamp of entry will be on your visa and the date will be on it.

2. Your destination is the country of visit, you only need to mention France as you were through Swiss airport in transit. You don’t need to mention Swiss airport.

3. Your BRP copy or visa signet in your passport in case you were issued a visa

4. Your visa before the grant of tier 2 visa

5. Think you are right.

The day you leave the country and the day you returned is not counted as absences as you were in UK in both days. So some of the time you have indicated will not be counted as absences. Deduct those days and do it again, but even at this it looks ok. However for those days that should not be counted, just mention them in your cover letter.

Where does it ask to enter the “number” of absences? 🤔
The form only asks the entry and exit date from UK and you have to mention the exact date regardless of if the departure of arrival date is not counted towards the absence (the number count is just for your reference or record)

Hello, Another question;
I have got a letter from my employer in which it is mentioned that my current contract end date, i am required for foreseeable future, SOC code etc.
In the same letter, they were verified salary slips. Is this OK?
Also, the contact details at the end are of Head of Payroll -- HR service centre, Is this (signing by Head of Payroll) is OK?

Thanks

another question: In the form, it asks me to tick "

For the period before you were granted leave as a Tier 2 migrant, documents showing that you met the relevant requirements of the immigration rules. For further information concerning the evidence required, please refer to the Tier 2 migrant policy guidance on our website" Document

I believe this is in case I am combining my tier 2 with other category, e.g. Tier 1. However, I am not combining. Shall I tick the box and provide nothing? As it wont let me go past this section. Any ideas?

Correct, nothing you need to provide if you are only relying on tier 2 time.
