Quick question

Post by Ondrej_S » Wed Mar 01, 2023 4:21 pm

Good afternoon,

EU national (settled) here with Thai wife. Her IRL has already been held for 3 years and would like to apply for BC. We did a spouse visa for 6 months followed by an EEA visa for 5 years and then applied for IRL.

She completed the live in the UK test and the Language test before we applied for her IRL in 2019.
The question is DID I use her language test for her last application or does she need a new one as it's apparently valid only for 2 years or so... I just can't remember If it was mandatory in 2018/2019 and would rather not to waste £1300 application fee based on my guess

Thank you for your time :D

If she applied for Settled Status (not ILR) after 5 years on the EU family route, then she did not require an English test. An English test can only be used again if it was used (and required) for a previous application under the domestic immigration rules.

She therefore needs a new test.
