Received biometric card BUT...

Hello everyone,

I have received my BRP card finally.

This is for the 10 years route family life.

This was varied against my previous Tier 1 Entrepreneur application which was originally submitted in 2016.

However the Home Office has not returned my original documents for the tier 1 application nor have they refunded me the application fee and the Immigration Health Surcharge.

Any advice please.

What documents needs to be returned? You submitted hardcopy?
Approach the IHS refund team quoting application and ihs references.

You stated a couple of months ago that you were an overstayer. How then is FLR FP a "variation"??

My application for extension for tier 1 Entrepreneur application early 2016 was refused due to a missing document.
As I was not granted right of appeal I took them to tribunal.

The judge sided with the Home Office but did state that I should be given the opportunity to reapply with the correct documents.

By then ofcourse I became an overstayer.

I took this opportunity given by the court to reapply with all the correct documents.

And it is this application that I varied for FLR which was successful.

It was not a 'variation'. Your application was refused. A Variation is when you vary an existing undecided application to another application. You should have raised the issue of the documents submitted with the Tier 1 application at the time it was refused. Application fee is not refundable as the application was refused.

It was a new application when you had no legal status.
