Hi,

I travelled UK in Dec 2011, in ICT long term staff migrant visa valid up to 10th November 2016 . However I moved out of UK in May 2015 and it`s been a year now staying outside the country. My query here is, if I travel back to UK with my existing visa, will my cooling period be waived off. Can I continue extending my visa within UK itself. Please advise.

Cooling off period doesn't apply if you are leaving and reentering on the same visa.

Cooling off period is applicable if you want to apply for Tier 2 General now rather than remain on Tier 2 ICT.

I don't think you can extend beyond Nov 2016 unless your pay is > £155,300 pa

It all depends on what your long term plans are and wither you want to cease your current visa in favour of a new visa.

If you return to the UK on your current visa you essentially engage it again and everything carries on under those visa conditions.

If you plan to remain in the UK beyond the visa expiry date have you considered your options? Which brings it to back to the first point above.

It may be beneficial to move to a Tier 2 General to return as you have already completed your cooling off period.
