Regarding UK Tier 2 general visa

Could anyone help me on my below query please.

Currently, I am working in UK on Tier 2 ICT long term visa from May 2012. Now, I got another offer and the employer is ready to sponsor me Tier 2 General visa. But, I am not sure whether it is possible or not. As I am aware, I have to back to my home country and after serving one year cooling period only I am able to switch.

However, some one is suggesting switching is possible as my current ICT visa is active and I am currently working on this visa. Once I get sponsor, I need to go back to my home country and apply for tier 2 general visa. If tier 2 general visa stamped then after coming UK, I have been advised to resign to the current company and join in the new company which sponsored tier 2 general visa. In worst case, if Tier 2 general visa rejected, then still I can able to come Uk on current tier 2 ICT visa and continue my job with current employer.

I am not sure how far it is correct. Could anyone advise on me this please.

The 12 month cooling off period will apply to you if you want to apply for Tier 2 General, there is no way of getting around it.
