Renting new place - Refugee BRP expiring in a month

Hello. This question is related to "Right to Rent" checks.

I am a British citizen, but my spouse is not. My spouse has a 5-year time limited refugee leave to remain due to expire in Q1 2019.

We were given notice that at the end of our current tenancy the landlord would like to reclaim the property at the current tenancy term end in two months.

How can we prove that my spouse has the right to rent if the time-limit visa ends very soon after (1-2 months) the new place tenancy starts? Of course my spouse is eligible to apply for ILR at the end of that time period through SET(P) route, but how can this be proven to a prospective landlord? :roll:

Any advise would be welcome, thanks!

Did your landlord issue you with a Section 21 Eviction Notice??

Correct, Section 21 notice, with the correct 2 months notice period and the correct corresponding dates in relation to the tenancy agreement and its ending tenancy period term. We look to move anyway and it is an agreed/amicable arrangement.

Just wanted to state that in this case, the tenancy does not end at the end of the two months and there is no requirement that you vacate the property at this point.

Simply advising in case you want to buy a bit of time.

Thank you for clarifying this CR001, we appreciate the advice. If we are unable to secure a new tenancy we would have to go down that path...

I would also appreciate some opinions in the case of trying to rent a new place with the non-British partner BRP expiring in 1-2 months time and apparent subsequent eligibility to apply for ILR...
