Request for advice on ILR application route

Hi,

I would greatly appreciate your guidance regarding my husband’s upcoming application for Indefinite Leave to Remain (ILR), which he plans to submit at the end of November. Based on his visa history, we are unsure whether he should apply through the partner in family 10-year route or the long residency route (10 years).

Here is a summary of his visa history:
• March 2012 – April 2018: Tier 4 Dependant Partner (Student)
• April 2018 – April 2019: Tier 1 Graduate Entrepreneur PBS Dependant
• April 2019 – January 2025: Family Member as a Partner on the 10-Year Route

We would prefer for him to apply as a partner under the family route to obtain ILR. Based on the details provided, do you think he is eligible to apply through this route?

Your husband doesn't qualify for ILR on the 10 year partner on the family visa route yet. He needs 10 years on this specific route to for ILR on the family route.

If he meets the requirements for 10 years long residence, he can use form SET(LR) to apply for ILR based on long residence.

Why would you 'prefer' the partner under family route specifically?

Set LR 10 years long residence has less documents than the family route.

My question is about my husband, who has been a resident in the UK for over 12 years and 8 months. When completing the application form, one of the questions asks for details of all trips taken since he began living in the UK. Between 2012 and 2014, he had numerous trips, and he doesn’t want those two years to be considered as part of his application. In fact, he has delayed applying until now due to the length of those trips. Does he need to include them in the application? How does the officer calculate?

We could not find his expired passport for 2014 to 2019. What documents are accepted by home office officer to cover those years to show his residency? Is our son’s birth certificate or nhs letters fine with them?

You do not need to prove residency. Do you roughly know the absences?
