I currently find myself in a similar situation with conflicting advice from thr Home Office helpine.
COA - unable to confirm right to work - does Section 3c apply to EEA-EFM applications?

Section 3C is applicable under the UK Immigration rules, not the EEA FM or EU Directive regulations as far as I am aware and per the information in the link.
