I'm just wondering how possible it is to actually have your employer pass this test?
If I am doing the test it means my job is not on a shortage list which means anyone could answer the ad and be considered qualified for the job. Why would I think that I have any chance against this? Trying to find success stories online but can't... anyone have any advice or experience?
I was on Tier 4 student, then I got an internship at the place I want to work which moved me to the Tier 5 government authorised exchange. Now they want to offer me tier 2 to keep me permanently, but I am just trying to understand how realistic it is.
it's a pity that I didn't go from Tier 4 straight to Tier 2 as that would have exempt me from the RLMT, seeing as I studied in the UK and have a bachelors degree from it. Just have this tier 5 inbetween. (1 year between the two)

Tier 2 visa route does not exist just to land you your dream job. And its up to you how you manage your migration adventure.
But clearly the members in Tier 2 forum who are on Tier 2 visas have passed RLMT hurdle (as appropriate).

Any business using Tier 5 to fill roles with the expectation that there is an easy route to tier 2 thereafter does not fully understand the difficulty they will face in realisticly meeting RLMT.
There are many successful individuals applying for tier 2. What some tier 2's don't understand is that getting your visa does not guarantee that the RLMT is valid and has been approved. That is not the case, it just means the Sponsor has said it is valid.
There is one major hurdle to overcome- pre-selection. Being in the role under tier 5 and moving to tier 2 almost certainly will raise the question. Why you and not someone else and why not a settled worker?
It is not impossible to move from tier 5 to tier 2 but the RLMT has to be conducted in a fair and open manner.

Does it not make a difference that I studied here and have a UK bachelors degree. The only mistake I've made is going from Tier 4 to Tier 5, rather than straight into Tier 2. Surely this has an effect on the decision process as a whole assuming all other paths are done correctly.

It does make a difference in terms of proving you have the English language requirements, but not as an exemption to RLMT.
Tier 4 to Tier 2 is an easier switch as you would be exempt however, we don't know how long that will be the case...

Also, I don't see why the journey from Tier 4 to Tier 5 would have an impact on any decision.
Decisions are purely based on POINTS - if you tick all the boxes correctly (one of which is passing the RLMT), you will be successful.

I already know that I have to do the RLMT, I meant does it make my case stronger (assuming I do the RLMT correctly and no one qualified answers) that I studied in the UK and just recently came off my Tier 4 where I would have otherwise been exempt from doing RLMT?
I'd like to think the home office looks at all pieces of an application and not just tick boxes....

Your previous immigration history makes little difference under PBS. You either meet the requirements or you don't. There is not a moving goal line based on how successful you were under a previous visa type.
You moved to tier 5 from tier 4, you can't change that. If all things are equal and the proper process followed and that leads to a COS all well and good.

Adding to Frontier Mole's point above.
Your history has no impact on RLMT.
A successful RLMT will prove that "no settled workers who have applied were suitable for the job" or simply "no settled workers have applied".
When providing the details, the company really shouldn't mention you or your history at all.
The point they're making is not that you're the best one, but that there were no one in the workforce who could fill this position.

Yeah thanks. i want to avoid the whole "pre-selected" assumptions so will just stick to all the check list points and hope for the best.
Hopefully since it's nearly December and the job is quite specific I will get lucky with minimal answers.
Thank you for all your help

Having read your other post regarding SOC.
The industry you are in is well known for tier 2/5 abuse trends. The "paid engagement visa" came in to provide a viable route for creative types that really did not qualify strictly under tier 2/5. Particularly models. This has tainted the immigration view of the industry and there is a good deal of scepticism in regards how the industry operates.
I believe based on the role you perform it can not meet NQF6. You are an assignment booker, it is not a particularly technical role nor has a high degree of skills attached to it. I have seen the role being performed and I have seen it claimed to be NQF6. It is certainly not NQF6 activity. Yip there is much massaging of ego's and dealing with the diva clients and models but essentially it is a booking process. X, y and z all have to be at the same place at the same time... job done.
If we were talking about taking kids to the zoo as a school trip it is the same functions. Kids to bus, parents, helpers and teaching staff on bus, bus to zoo, look at animals... job done.

Hello
Just another side question related to this topic - if one is clearly pre-selected before the RLMT, however after the RLMT is properly done (i.e. at the right websites for sufficiently 28 days, with all necessary info as required, etc.) then there is no applicant to the role, will this be acceptable? (provided that all required information is provided in the CoS)?
I don't see pre-selection is not allowed in the guidelines provided that the RLMT is perfectly completed. Please correct if I am wrong.
Many thanks

There was a refusal reported the other day as the pre-selected applicant's job offer was dated
before the job's closing date.
So pre-selection is not foolproof even if noone else had applied.

It's true I won't compare my job to scientist or engineer, but given the level of professionalism and clientele involved, it is a high tier job in another sense. Just as 'Theatrical Agent' is on NQF6 level, I think a reputable booker could be considered the same.

Agreed, comparing it to school trip booking seemed harsh.
A good booker will come with connections and an understanding of event operations that can be highly strategic to a big agency.

Sorry, but why would it be considered event organiser and not theatrical agent? We are working more in for the organisation and career development of the creative individual, not organising events...

FrontierMole was using it as an example.
I would strongly suggest you heed FrontierMoles advice.
