It takes 5 years for a conviction to be spent. It has nothing to do with points on licence. If I were you I would declare both.

Hi brother If you are convicted court before your 28 day prior to eligibility- I am afraid you will have to wait for 5 years from the date of conviction to have it spent. If you are not convicted by then I would still mention but it will be in the hands of caseworker. It is possible you may get ILR....

As mentioned by Guru I would return all the claimed amount with a good explaination and then claim in your name. You can claim back for upto 3 months.
