It's funny because that was just a temp stamp of 3 months expiring on 12 Oct.. looks like they will send me my passport and GNIB back just week before the expiration. and then I'll have to send them back again for another temp stamp.

there is difference between applying and requesting. 1. you don't apply temp stamp 1 (there is no way/process to apply temp stamp 1).. 2. you just send letter, request department to issue you temp stamp 1.. and then its on department, they give you OR not.. their response was simple you already have temp stamp 4, and your application is in process. and DBEI can't over rule EU treaty permission. that's why first need to wait for the decision of EU treaty right.
