As long as you fulfill all the requirements of ROR and PR after divorce, you should not have any problem. Residence card is optional.

Also your PR time start from the date of marriage, not from the date of your Residence card issue date.

You can apply for PR at your fifth marriage anniversary provided your wife been qualified during that period (from marriage till fifth marriage anniversary)

Hi obie,
He is working continuously from 07/2016 until now and he got decree absolute on 02/2017...
in order to secure PR, he only needs to demonstrate that his ex was exercising treaty rights from the date of marriage till decree absolute...

You have been unemployed before divorce hence you will be alright, so you don’t need to worry.

You have to fill that form

You don’t need to return it once received.

You need that passport which has EEA FP on it.

what are the exact dates when you were unemployed, if you were unemployed before the divorce finalised, it should be alright but to qualify for PR, your spouse should have been employed from marriage till decree absolute, then from decree absolute till the fifth marriage anniversary you should be em...

You can ask for your passports to be returned and it will not affect the application process, and while filling the form online, it will ask you that Would you like to withdraw the application, make sure to click No...

You should be able to apply for BC straight away, because your six years timeline starts from the date of marriage under EEA regulations, basically you need five years to get PR status then one year of holding PR status amounts to six years for BC. For ROR , you need to get divorce first which means decree absolute, You need to make sure that you been married for at least three years before divorce proceedings began and you and your spouse lived in uk for one year during marriage , your spouse needs to be qualified person during divorce procee...

What is the date on letter which you received with your PR. It should tell you the date when you acquire the PR status and if your spouse has been qualified since 2009 then you should have acquired PR in 2014... you can apply for citizenship after acquiring the PR status for one year.

Your husband is British citizen as he will be treated as someone with PR, so he doesn’t need to exercise treaty rights in uk, you might need to show that he has been qualified in the other EU state...

As you have got a PR, so divorce will not affect you. You are no longer dependent.

You should be fine as retained rights should be lost if you are no longer qualified person or you acquire PR. And also if it is cancelled then you should have been communicated regarding this...
