Re: Spouse Visa Curtailment after 2 weeks abroad?

Presumably she will need to go through the spouse visa renewal process again in less than 6 months, at which point the HO will not issue her visa and she will be made to leave? Or does she intend to overstay and not even apply for the extension?

Re: Spouse visa refusal

Brian, I am no expert, but I would say you have grounds to appeal that decision, you can't help the fact that your employer did not pay the NI or tax for you, that is between them and the IR to fight over. I would speak to a lawyer, mine was excellent, so if you want to PM me I will let you have his...

Re: Travelling restrictions UK spouse visa:How long can I stay outside of UK with UK spouse visa.

Seagul, the OP asked how long she could stay outside the UK without affecting her spouse visa, you said "no absence limit", which is probably incorrect. So somewhere between what you said and zero days is the answer. You have provided no backup for your statement, the only detail I can find that you...

Re: Travelling restrictions UK spouse visa:How long can I stay outside of UK with UK spouse visa.

See this paragraph. "The earliest you can apply to settle in the UK (called ‘indefinite leave to remain’) is after you’ve lived in the country for 5 years continuously with permission to stay (‘leave to remain’) as a partner. You cannot count any permission to stay in the UK as a fiancé, fiancée or ...

Re: Travelling restrictions UK spouse visa:How long can I stay outside of UK with UK spouse visa.

I am not sure that there is no limit Seagul. Don't the HO require evidence that the applicants were living together, when the extension for the further 2.5 years is applied for? What you imply is that the two people can live separate lives in different countries from day one of her visa being grante...

Re: Problematic marriage with my exotic foreign wife.

Well Abused, I am pleased you seem to have taken a step or two closer to resolving things happily. I will always tell the truth or say nothing at all. My previous GF was also like that, all of her previous partners had cheated on her and and so she accused me of cheating every time I did not answer ...

Re: Spouse Visa extension applied too early!

That raises an interesting point. In around 2 years we will need to apply for my wife's spouse visa extension. So, how long before the end date of the visa should the application be made? Is it OK to apply a week before and remain in the country while the application is being processed but the visa ...

Re: Apply for my husband to come and visit our British child

Smah, A Spouse visa costs a lot of money to apply for, plus the NHS surcharge (which is refunded if you fail), and then you have to go through the whole thing again in 2.5 years. Plus, if you are getting legal advice, this must be costing you too. Since CRO1 has pointed out, that you do not seem to ...

Re: Spouse Visa extension refusal

I would at this stage, certainly get a solicitor. It seems you have made some mistakes, or presented the information incorrectly (it is confusing, so not a criticism) and I would now get someone who can give you the best shot.

Let us know how it goes.

Re: Bringing my Filipina partner into the country for marriage and possible settlement.

Hi, It depends on what your plans are when she comes over? You could get her a visitor visa, but hard to prove she will return, so might be rejected. Holiday only. The unmarried partner visa, you would have had to live together for two years outside the UK. I think you can then apply to marry in the...

Re: False tourist visa info's impact on fiance visa application

Plus, I am guessing she just said in her application that she was single, and she could argue (if it ever came up as an issue, and you would probably be given the opportunity to explain and appeal) that she technically was.

Re: False tourist visa info's impact on fiance visa application

Rtbb, I can tell you from personal experience that the HO do not read fully the information sent, they will not know, nor will they care, where you fiance spent her time when she came to the UK to visit. It is all completely irrelevant. Just apply for the visa making sure you include everything you ...

Please do keep in touch. Sometimes it helps to be able to talk with someone who you don't know, because you don't want those that do know you to judge you or perhaps you feel embarrassed to talk with them about this situation. It is always easier for someone who is not involved to say leave someone ...

Re: Problematic marriage with my exotic foreign wife.

I don't know your situation, so sorry if I am talking out of turn. Why do you need an extension? After 2.5 years, if she goes off with someone else, you can tell the HO and she will not be able to stay in the UK. After the first 2.5 years you need to apply for an extension of 2.5 years and prove you...

Re: Visa Granted After 3rd Application

AKKK123, your case looks straight forward and an appeal should work if you can submit the evidence that the HO says is missing. It is similar to my case and others on here, and it took around 10 weeks total to get the whole process completed, and a further 10 days to get the vignette in her passport...

Re: Appeal timeline for dependent married visa

Get a lawyer and get it done right. Make a mistake now and you will be back at the start again, and it is so much longer process and more costly from there. My lawyer was £765, and took the frustration of all the process away from me.

Re: Appeal timeline for dependent married visa

I believe it is 30 days to appeal the decision. If it is like my case, you register and pay for your appeal, and then wait about 4 weeks until you will receive a case ref number. Then you can submit your appeal evidence and make your case. Then it about another 4 weeks until you will hear whether th...
