yes you will likely be refused because you are illegal until jan 2012. So your application will consider only 10 years after you have legal right to remain in the UK, which should be jan 2022.

So from your information provided, your partner's continuous residency has been broken (absent more than 180 days since 11 jan 2018) and the clock reset to zero.

they count all absence from 11 jan 2018, no matter you renew the visa on may 2018 or not, and counted in rolling manner. so since 11 jan 2018, if leave the country more than 180 days, the continuous residency broken and clock reset to zero.

you need to provide the detail what and how your partner claim benefit.....

It will affect your ILR if your partner put your name together for the benefit application, especially if your partner can get more benefit than if he/she applied alone without your name.
