Re: British Passport refused for an adopted child of EEA cit

On the other hand- if the Passport Office grant a British passport to a non-citizen, the passport is invalid and may be withdrawn, or renewal denied, at any time. That may be true, but it is not applicable here. There nothing to suggest that the person is a non-citizen. The only issue is the suspic...

Re: Additional documents

On 2005, all students were allowed to work 20 hours during term time, which I did. I renewed my visa 4 times and received my ILR too, never any issues. Not sure why Now HO wants to see a evidence of receiving authorisation. Anyone faced this kind of problem ? Not sure what to reply back to HO. This...

These are all separate applications, AN1 for you, and I think EEA3 (EEA PR?) for the kids. It is actually 85 pounds, because of biometrics, but probably still worth it.

Re: Not renewing British passport any advice????

I would never advise to use deception in these matters (although I accept that it is sometimes necessary).

The only clean solution is to give up British Citizenship, which is a rather radical step. Would you consider that?

Re: MN 1 Naturalization CERTIFICATE NOT RECEIVED

The home office bureaucracy is pretty disorganised in my experience.

I would recommend to write a letter to your MP - they can enquire with the home office.

Re: British Citizenship Enquiry

They do not have to give up German citizenship - a second European citizenship is accepted. Of course both nationalisation and registration are pretty expensive, but it may be worthwhile. Theresa May's current plains for ILR for EU citizens may be even more expensive (the usual fee for ILR is over 2...

Re: British Citizenship Enquiry

In theory, their status is protected in any case, although with the current trends in the home office I would not rely on that. However, since they have all lived in the UK for 5 years, they have acquired PR by now, and therefore have their own status. It may be worth applying for PR for the whole f...

Re: EEA spouse NOT working applying for British citizenship

Usually you would use bank statements to "prove" residency, but the NCS advised against using bank statements. They said either tax or benefit records, GP registration, or doctors attendances would be recommended. So we went with the later. We will see how that works. If in doubt, I would also submi...

Re: EEA spouse NOT working applying for British citizenship

I agree that training for European rights is very poor, and my suspicion is that this is by design rather than by mistake. If you study the casework guidelines, you also find many cases where the guidelines are wrong, and then there also a number of instances of procedures being clearly illegal etc....

Re: Absence over 450 days in 5 years

Check the booklet AN Requirements - it has quite a detailed list on how and when discretion is exercises with respect to the absences. The 600 days seem to be not a big deal if they are mostly work related, which should be obvious from your list of absences. The 120 days in the last year are possibl...

Re: Passport for a Child of a EEA Citizen - being asked for

There is no central definitive citizenship database and citizenship must be proven by the applicant when requested. Even a British passport is only prima facie proof of British citizenship and the person can be asked to prove again that they are British citizens. Yes, of course a passport can be is...

Re: Britsh Citizenshp and Knowlege of English

No. I looked into the alternatives, and they are at least as expensive, and usually more arduous. To be honest, the whole language test is more of a biometric exercise anyway. They take your picture, they take a voice print, and they check your passport at every single step. It is not really about y...

Hello, pls has anybody travelled before while his application is ongoing? Pls somebody help me with answer. We did, but that was years ago. You have to apply for an EEA FP (if you are a family member), although you can probably avoid that if you can get in on a tourist visa. Things may have changed...

Although she has offered nothing new but her conditional offer is a good thing imho. She wants the same reciprocal rights for the British citizens living in EU - which surely is good thing. No? No, it is not a good thing. The EU offer is to keep the existing EU legislation in place - to treat Briti...

Re: Need guidance as to how my family shoud proceed

Ok, let's separate the two problems. For your sister, registration using MN1 is an option, because her child was born in the UK (I assume), and your sister has acquired permanent residence status through 5 year legal residence in the UK. For you, the situation is different, because you are not born ...

Re: Need guidance as to how my family shoud proceed

According to what you said, the answer is the same in both cases: you are not a British Citizen, but you can register using form MN1. It is expensive, but not as expensive as naturalisation. In any case, I would recommend applying for Permanent Residence where applicable (although Theresa May said t...

1. It depends on your immigration history, and how you got ILR.

2. Personally I would not care, but I imagine that could be an obstacle.

Re: I dont know what i am, how can i find out what i am

That is an interesting question, and there are a few possibilities. It does depend on the status of your mother, too. Do you know whether she every applied for ILR? And if so, did she register you as a British citizen? That would have been the best course of action, but I guess you would know about ...

Re: EU citizens' children's citizenship born prior to 2 Oct

Outrageous to you perhaps, but it can make sense. An EU citizen with PR has a right to reside permanently under EU law. But if the EU ceases (or ceases to apply to the UK), there is no reason to assume that EU citizens are settled in the UK any more. Thanks for the long answer. I was just referred ...

Re: EU citizens' children's citizenship born prior to 2 Oct

That is a very strange statement, but it does highlight a number of interesting issues. Technically, EU citizens are not subject to any time limits on their stay. Does that mean that they should be considered settled? In terms of freedom of movement, if the EU is truly a common market, barriers have...

Re: Evidence for naturalisation EEA family member

This is a good question, but the answer is a bit confusing. In terms of the law, you have to demonstrate residence for the past 5 years before nationalisation. But the UKBA expects you to do that using an employer's letter or a university registration - they do not accept bank statements, council bi...

Re: route for children of married EEA nationals in 2004 & 20

I am not 100% sure about the child born in 2004, because the law changed at some point. I think you can ask for registration because on the settled status of the parents, which is easier (and slightly cheaper) than naturalisation. For the child in 2008, it would have acquired BC at birth, because yo...

Re: Referee electronic signature for Citizenship Application

I very much doubt it. While an electronic signature can be quite secure, it can only be checked on an electronic document, and usually not in paper form. Therefore a printout of an electronic signature is essentially useless. If you mean a scanned copy of a signature, that usually depends on the cir...

If it makes them happier, then there is no harm in supplying what they want. However, there's also no harm in pointing out that travel documents satisfies 2.1: 2.
