I would have said the implication here is that EEA nationals and their family members are exempt from the Immigration Rules because they are governed by EEA Regulations.

But I agree that this is a little too ambiguous, particularly where family members might be concerned.

There are no restrictions on you working in the UK , and you should apply for a National Insurance number, although you can start work before this is issued. Your visa was issued with KOL Req. Have you taken the Life in the Uk test yet (KOL), as once you have passed this you can apply immediately f...

They might not have to suspend anything. A lot of potential Tier 2s, chefs and care-workers in particular, are looking elsewhere - even the ones already here. The problem is that a reduction in overseas migrants could result in a spin-off loss of a few billion £pa for the UK. :( With the outcome be...

Aren't unmarried partners classed as 'Extended Family Members' ie not 'Family Members'? A very important distinction.... Yes they are - and yes it is. With regards to your comments: firstly I was assuming that 'durable relationship' also falls under the new regulations even thought not specifically...

I'm assuming your friend checked to see that she met all the other requirements for settlement including the KOL test? If she submitted the ap...

My point was that we probably do the same to those comming to the UK, as Australia is doing to the OP. It's wrong and should be appealed against if possible.
But that doesn't make any sense. Two wrongs don't make a right.

I think one of the unfortunate effects of immigration control is that it can end up bidding us against...

Rastadude198, Your lawyer is having a laugh and has just raised your hopes needlessly. If you paid money for representation then you should try and get at least some of it back. Not only do you not fit the requirements of Para 317, you don't even come under the Immigration Rules. This is because you...
