Guerro Agree with what you say, makes sense to a reasonable mind. However do remember that there is no such stipulation in the EEA directives on providing proof of EEA national exercising treaty rights. This is what the HO asks for as this is the way that they have implemented the directive. They ha...

Guerro unfortunately this is true, for retention of rights you would need to prove that the ex was exercising treaty rights in the UK from the initiation to the time Decree Absolute was granted. If you cant do that then you will fail to retain rights of residence. If the EEA national leaves UK and s...

Re: Does the 1year visa EEA family permit count for HO as re

The clock starts ticking once you are married. So if you were married and came to the UK in 2004 then you should have had your PR in 2009. So the 1 year will count towards calculationg the date for PR. Hi all, Recently we applied for PR through EEA3 & 4(for my wife) and we are still waiting from HO....

if your wife leaves UK without divorcing you and continues the proceedings in any other EU conunty then I am afraid you will not be able to prove that she has been residing treaty rights from divorce initiation to decree absolute, which is what is needed to retain rights of residence. hphpas, If your wife is in the UK, exercising treaty rights when the Decree Absolute is issued and you can prove that she was exrcising treaty rights here from divorce initiation until the decree absolute then you may qualify for retaining your rights. Re: Retain Rights

Just to update everyone, i received my passport yesterday from the HO with a brand new RC valid until 2015. They sent me the wrong covering letter, cancelled my previous RC and issued me a new one for 5 years. So I guess I was successful in retaining my residence. Applied: 11 Feb 2010 HO Recd: 12 Fe...

Re: family member of eeu geting divorce

I agree with troubled, if you are divorced then you have to inform HO and there is no way you can retain your rights of residence based on marriage as you don't qualify. You will have to make your marriage work, if however its too late for that then I am afraid you will need to inform the HO and wai...

mate a letter itself will not suffice. Remember the onus is on you to furnish all information to the HO and then wait for them to get back to you. Unfortunately I do not agree with this, as the rules clearly state that the 3 years should have passed prior to divorce initiation. This clearly means that an Application for divorce (Initiation) should be made after 3 years of marriage. Agree that the family memeber is safe until the Decree Absolut...
