capping extensions

The MAC will look at capping extensions because the target is reducing net migration. So getting more people to leave has the same effect as reducing new entrants. Losing hard working, talented, tax paying tier 1s is clearly the worst option for the UK, but it is good for big businesses that want to...

tier 2 cap on extensions too?

The 20000-1300=18700 cap on tier 2 general seems high for entry clearance/out of country applications only. Is it a cap on CoS and therefore includes extensions, significant changes of employment etc too?

only out of country tier 1 general capped?

As far as I can tell the cap does not include those switching from tier 2 general to tier 1 general so maybe it won't affect as many people? It might even mean that the cap is an increase in 2010 over 2009. The extra 5 points seems a bigger problem. The UKBA impact analysis based on 2009 application...

I was doing phone interviews for some jobs in the UK and US for a big Swiss bank a few years ago. Most of the applicants that I interviewed were either in India or from India on H-1B visas in the US. Only 2 of over a dozen actually had the experience they said on their CVs. Most had not even bothere...

Have you received payslips? It might be clearer on them.

I don't think Indian salary is included on the P60 in some cases but in others it might be.

It should not be difficult to work it out if you know the net payments that you get and how that compares with the numbers on the P60.

If Sushil is an accountant then he probably understands the rules better than I do. However I do not think the 'temporary place of work rules' depend on visa type, but do deoend on how long you will be at the site. As soon as it is likely to go over 2 years then the tax break no longer applies. This...

Exactly, I doubt even Damian Green knows yet, but to cut net immigration below 1,00,000 he needs to cut 90,000. There were about 1,00,000 new tier 1 and tier 2 plus dependents in 2009. If you exclude tier 2 ict then it is probably 60,000. These are rough numbers but you can see that the cap could be...

Both should be on payslips, but if you have the P60 and add allowances then you should get the gross.

The Conservatives cannot achieve their targets on net immigration by just limiting new applicants for tier 1 and tier 2 (especially if tier 2 ict is excluded). So it seems likely that they will either target extensions or make make some cosmetic changes and hope that satisfies their anti-immigration...

I guess everyone should be getting P60s showing what has actually been paid gross. If this does not match the gross that should have been paid, then politely contact hr/payroll. If they try to put you off then threaten to contact HO/UKBA. After that it depends how brave you are feeling and whether y...

temporary place of work

The tax dispensation is based on the temporary place of work rules, so as long as the placement/deputation is for less than 2 years then it would still apply. The UKBA recently indicated that they had found some sponsors were claiming the tax break but not paying it to their employees. So they were ...

If they operate a rotation policy and move you back before 2 years then they are probaby claiming tax back for you but keeping it. The UKBA know about this scam used by certain Indian IT companies and it was in the policy updates recently.

I know someone who was in a very similar situation. They contacted solicitors and I contacted a senior union person in Unite for them. No luck. If the sponsor wants to send you back or get rid off you then you don't have many rights especially under tier 2 ict. Find a job with a proper UK employer a...

so it is not illegal or at least unenforceable?

It sounds like as long as the contract is worded correctly it is safe to send employees on tier 2 visas to work for a client.

Its the companies abusing migrants that are the target

The intra company transfers are abused by big companies to undercut the local market. This affects locals and hsmp/tier 1/flr/ilr people as well. If you are affected and know something about the abuses then report it. What's the point of getting hsmp/tier 1/flr/ilr when all the jobs are going to int...

If you don't mind me asking, is the allowance any better that the £1800-£2000 a month that TCS used to pay? (I don't know what they pay now but heard that there might be cuts)

allowance versus salary

Hi MVaibhav,
how safe are the allowance versus the salary?
A lot of companys are looking for ways to cut back and one might be less likely to be cut.
