Delayed entry - ILR

Hi, My wp wa issued late 2008 and I enter the uk approximately 2 months after the issue of wp. I know that you can apply for ILR 28 days before completion of 5 years. Also in the code of practice it says: as long as the first entry is delayed less than 3 months it doesn't count as absence. So in thi...

Only those who entered Tier 2 (or the work permit arrangements) before 6 April 2011 may be paid below these thresholds, when they apply to extend their stay, change employment, or settle in the UK. However, in most of these cases, the “experienced worker” rate will apply; the “new entrant” rate wil...

My entry is delayed app. 2 months... :S

My Partner claiming benefits

Hi,

I'm on a WP and my partner is an EU national. She's been unemployed for awhile and is applying for "jobseekeeking allowance" or stg. We're living together and the application forms are asking about partners, their employement etc as well.

Does this effect me and my eligiblity for ILR?

Thanks

I would be careful with the timelines when doing such thing... I think before your new visa is granted your previous employment must be already finished otherwise you'll be in breach of your new visa. As far as I know, you should quit your current job, notice period ends then start the application f...

Would your salary come from the UK company of from the overseas subsidiary? Thanks for your message Lucapooka. This is an opportunity with a new em...

UK Based overseas job

Hi, I'm sure it's been asked, discussed and answered several times before but as you all know the rules keep changing. I have been working here with a WP for 3 years and now there is an overseas opportunity. The company is UK based and I can negotiate with the company to come back to UK every 3 mont...

I really don't know and can't figure out an answer to your question but I wish you good luck. Hopefully it will work out well! But I also find that "employer has to declare that they still need the migrant" rule is very silly and makes no sense. I mean the employer made an offer to you because they ...

I have just compared the current rules there seems to be only one difference between them. Paragraph (b) of Tier2 and Paragraph (ii) of WP Requirements for T2 ILR (a) The applicant must not have one or more unspent convictions within the meaning of the Rehabilitation of Offenders Act 1974. (b) The a...

One thing to check is that your new job is NQF6 or above (which you can check in SOC) because that will be a requirement for T2G from 14 June. Your new employer is likely to have to carry out a RLMT and only if that is successful can they assign a CoS to you. Any job offer would be subject to that....

WP holder changing sponsor / job

Hi, I am a work permit holder an entered the UK late 2008. And when I entered my job was in the "shortage list". Unfortunately it's not anymore. At the moment it's quite likely that I will change my job/employer. And I would really appreciate if someone help me by explaining two things: 1. What are ...

There are two types of AA visas.

1) TR businessperson - you need to be in this category for 4 years to be eligible to apply for ILR

2) TR worker - you do not qualify to ILR under this visa category. But what you can do is go through "10 years legal" route if you stay on this visa for 10 years.

Just two questions;

- is it a final statement? Do you think they can change their minds again? (I@m becomin paranoiac I guess)

- Am I correct in saying: if I change my visa from WP to T2 I DON'T need to meet the £35K requirement.

If that's your only point, then you don't have one! The UKBA makes the rules and makes it clear they are subject to change at any time: http://www.ukba.homeoffice.gov.uk/visas-immigration/settlement/ "The Immigration Rules are subject to change, and you must meet all the requirements of the rules t...

But here the document clearly says that any one came in pbs after apr 2011 so we don't need to be worry about it if we applied before apr 2011. Agree? Agreed sheraz_aries. But you can see that they also mentioned that the changes would effect migracts entering point bas system from or on 6 april 2011. what your thoughts on this? That's what they initially said but now I feel like it'll apply to anyone regardless of when or how they entered any route to settlement...W...

Well, I guess they do have the right to limit immigration, or even to stop it completely - if they think it is going to be better for the country. What they do not have a right to do is to let people in on certain conditions, and then later on change the conditions. For example, what are the condit...

Has anyone got any infromation on what's going to happen to those on Work Permit but switching to Tier 2 yet?

All I got so far is generic responses, repeating the 'uncerainities' in the consultation paper.

I am not sure if you'll need it but, just in case get a copy.

Well...to me they should count all, coz they're both some ways of contributing to business, either as an employer or employee. I don't understand why we can't "mix'n match". But on the other hand these are the rules. So if you are made redundant, try to find a new company who can sponsor you. Otherw...
