Re: Maternity Leave Rules under Tier2

If you apply for ILR based on long residence and she applies for FLR(M), you can use joint income to meet the requirements.

Is she on a Tier 2 General as main applicant or as your Tier 2 G dependent? Your post is not clear.

It is not 'check and send' for naturalisation applications. It is NCS at the council. 'Check and send' is for passport applications through the Post Office.

Re: ILR and Tier1 dependent appication

If you are both applying on the same day, HO will have the record if your ILR is granted. Good reason for absence is : visiting family in home country, holidays etc. The longer she is away, the more evident and proof you will have to submit to prove subsisting marriage and cohabitation. ILR requires...

The premium service or in person process is not available for Right of Abode applications.

You will need to apply for a new one to prove your right to work.

Re: Refund of visa extension fee for less time granted?

So you have been granted an extension for more than 3 years, i.e. April 2016 to June 2019. You appear to have paid the correct fee then. HO don't refund visa application fees.

Re: Best ways to Reapply for ILR

2) You could investigate this path: https://www.gov.uk/returning-resident-visa Good luck. Likely won't work for the OP as spouse with previous ILR has been stamped in as a visitor more than once and this cancels the ILR status. The fact that the ILR spouse has not resided/lived in the UK for 12 yea...

Re: Child born to parents applying for ILR

He cannot apply directly for a passport, he is not British.

A UK born child DOES NOT require ILR to register as British on form MN1 under section 1(3) of the nationality act, which you can do once you are granted ILR and have your BRP.

Re: Best ways to Reapply for ILR

ILR is lost if you leave the UK for 2 or more years. Short visits to the UK does not maintain ILR. The fact that she has been granted entry to the UK as a visitor, means her ILR has been cancelled. She will have to start from scratch with a spouse settlement visa and a new 5 year residence period be...

If the error was yours, it will be quicker to reapply and submit the original statements.

An appeal can take many months.

If you DO NOT have ALL the passports covering the 10 years, you have to prove with documents that you were resident.

You don't need a detailed cover letter. The application form covers what HO needs plus the supporting documents.

What do you mean by brother sponsor? Are you on a EEA extended family residence card?

I don't understand your last question if you have submitted an application based on your British child.

And what do you mean by change sponsor? Change sponsor to who?

Re: Eligibility criteria for 90 days concession rule

Yes, I see. Thank you. Could you please kindly confirm that I calculated correctly the dates? I entered to the UK 10/08. So I can apply on 14/07 or it should be 15/07 to be on safe side? Or 14/07 is fine? If that is 'within 28 days' should be fine, but for the sake of one day, I personally would ap...

Re: Naturalization application from USA - obtaining biometri

There are some very relevant questions relating to your son and his mother that others will likely also ask, if they are inclined to. But the one I will ask is are you sure he needs to be registered as British if he is under 18 and has a British mother? He should be British by descent if born to a B...

Re: TIER 2 (GEN/DEP) HELP

Which FLR - FLR(O) or FLR(FP) - and on what grounds? And they are not free applications either (fee plus IHS).

HO is very much aware of irrelevant FLR(O) and FLR(FP) applications to 'buy time' and these are refused quite quickly these days if there are not obvious relevant substantial reasons.
