Re: ILR accelereated route, No decision untill now and nearly reached to 5 Years

If no decision will be made till you reach 5-years qualifying period then you can vary your application towards 5 years route which means only 2 Full-Time Employment need to be shown. Remember it will be a new application which means you may need to provide some new documents i,e business activity e...

Re: Exceptional Circumstances

I had an absence during October - 13 & April -14 due to an injury which led me toward hospitalisation and ongoing treatment even here. I was away for a total of 197 days and since after never had any absence for more than 15/20 days in any consecutive period.

Re: Document supplied in previous application not considered by case worker

Can you please quote the Immigration rule they specified in your refusal letter. If you are engaged in the business activity and if you have provided Current appointment report from companies house within 3 months before the date of your application then it won't be an issue. Regardless of you being...

Re: Document supplied in previous application not considered by case worker

If Business Activity is the only reason then rather going to JR it's better to apply with the new application. If you refer my previous response, specified document for Business Activity under Appendix A covers both Table 5 & 6 and required for Extension/Further Extension and ILR. My suggestion is t...

Re: interview for initial application

Best thing to do is to send an email to the interviewer and ask them to clarify this. In my opinion, so far no restriction in place neither I have seen anyone requesting to take support along but it's up to both parties to agree on terms. Providing supplementary answers are not something anyone can ...

Re: Tier 1 Entrepreneur ILR

The decision will be based upon relevant immigration rules which required business activity documents while in case of refusal no claim will be acceptable based on application checklist. Its always the immigration rules which need to be followed and supersede any guideline/checklist until sectary of...

Re: Interview

The caseworker guideline states that he/she should consider the observation of interviewer while making the decision. The whole concept of on-site Interviews is to get a snapshot of applicant's business rather than doing an objective assessment via video conference at interview center. If you had co...

Re: Extension Refused | Help/Advice Required Please

Still, You are absolutely fine with the job criteria and this must be overturned in your AR. I have gone through Appendix A again and very much confident that two part-time jobs can be combined together if existence for at least 12 months. also 49(f) states (f) If jobs are being combined the employe...

its Seems a case working error. Yes, the problems we have seen were for the same title for two or more job (where caseworker was looking for two separate jobs).

Do you come under the transitional agreement?

Never seen HMRC/Tax based refusal what was the exact issue?

Yes, you can apply for the Accelerated route if 10 Jobs have been created for 12 months or more. TOEIC matter is still in court after subsequent appeals by stakeholders.

b) Have your FPS had employee(s) details? name and NI etc
c) does it shows Gross Pay as well as Tax & NI deduction for each payment you made to your employee for the claimed period?

Re: Document supplied in previous application not considered by case worker

You may be correct and I am not challenging your knowledge. I have a copy of 46-SD as well, where what is missing in this case was covered in Para 48-of previous version of Appendix A. What I was trying to explain here was that OP applied for a 2nd extension which means he needs to observe Table 5. ...

Re: Document supplied in previous application not considered by case worker

I don't think any change related to "Business Activity" was introduced during past changes ( Ref: Appendix A Para 46-48) the only exemption can be used in ILR / 2nd Extension is the evidence for investment as following, "The applicant does not need to provide evidence of this investment if they were...

you can claim past 12 months employment exactly before ILR Application. So as per rules;

"where that leave was granted less than 12 months ago, for at least the 12 months immediately before the date of application"
