Re: COA EFM - no right to work?

Your earlier posts suggest that you are married to an EEA wife. Why did you then apply as an EFM?

Chen and Zambrano derivative rights may not lead to PR under the EEA Regulations.

But,Obie, do they count as legal residence for the purposes of ILR (Long Residence)?

If the applicant is paid hourly, Are you paid hourly, like a consultant or a contact centre employee, or are you a salaried employee? A person who is paid hourly is only paid for the hours that s/he works for the employer. If you get paid a monthly salary and have annual leave, you are considered s...

Re: ILR costs

Are you doing an MPhil or PhD in the Home Office fee structure? UK visa fees (from October 2014 onwards) UKBA fees (April 2013) The current government target is for the immigration system to be self-funding. As EEA applications are practically free (only £65), the cost falls disproportionately on no...

Re: British Citizenship refused - residence requirements

Because you are the spouse of an EEA citizen, your passport ought not to get stamped by any EEA country including the UK, especially if you are also carrying a Residence Card or Permanent Residence Card of any EEA country. If you acquired PR in 2013, there is a good chance that there is no UK entry ...

Sorry for your loss. Life does take unexpected turns and occasionally, they are to our detriment and bring us grief. I am aware that I may be being a bit insensitive in asking these questions, but the ECO will be thinking on very similar lines. So, I hope that you are mentally prepared for difficult...

Re: British Citizenship - Elderly Parent

As others have mentioned, it is practically impossible to get your parents to the UK under the UK Immigration Rules. As an aside, if you bring your parents in under the UK Immigration Rules, you will have to sign an undertaking confirming that they will not make any demands on the health, welfare an...

Re: Can my wife and baby apply BC once I become BC from ILR

So for my wife, she has to get ILR first in March 2018 (5 years living in the UK) and then apply BC in 2019 (1 year after ILR)? If you have become a British citizen, she can apply for naturalisation immediately after getting ILR in March 2018. No need to wait for a year. For my son, I can register ...

Re: EEA ILR, Children Passport Application Refused?

We are also trying to get a SAR as to determine for what period the PR was awarded but that still wouldn't be a legal document enough to prove to HO about my spouses PR status or if you guys suggest otherwise? Sensible to get an SAR done. Ironically, because PR status is granted by the law and not ...

Re: Can my wife and baby apply BC once I become BC from ILR

Child can be registered as a British citizen now (as you have ILR). Wife needs ILR, which takes a minimum of five years, before British citizenship. After ILR, she can apply immediately for British citizenship as the spouse of a British citizen, provided she meets the absence and other requirements....

Go through Page 9 of the Guide MN1. You will need proof that you have lived in the UK for at least three continuous years with absences of no more than 270 days over the three years. You can apply as soon as the child is born, but be aware that some registrations are taking about six months to a yea...

Re: Citizenship of Baby Born Overseas to UK by Descent Fathe

If the child is not yet born; It would be beneficial for the child to acquire citizenship by being born in the UK. However, be aware that getting the visa for the mother-to-be may take a while. If the mother is a non-EEA citizen, she would not be entitled to NHS support unless she comes to the UK on...

Re: EEA -registration certificate - Need Help

No of children, how the EEA citizen spends his/her time and her income amount does not matter. The EEA citizen needs to be exercising treaty rights, in this case either by doing "genuine and effective" work or by being self-sufficient with CSI (private health insurance). If she can prove that the wo...

Re: Spouse lives here so what is his country of residence?

What are your nationalities? If you are British, how long have you stayed in Ireland and did you move the "center of your life" there? Did you intend to do a Surinder Singh? An Article 10 Residence Card allows travel across the EEA provided the holder is either accompanying or joining the EEA citize...

Workers do need to prove that the work is genuine and effective, so they do need to provide proofs like pay-slips, P60s, bank statements, etc.

Re: unpaid NHS costs reapply

This just in. It is likely that users will now need to present two pieces of evidence of eligibility to access NHS services.

So, you can see that the UK is cracking down quite hard on NHS usage by people not entitled to it.

I would not get your hopes too high about getting a visit visa.

Re: PR for EEA member&spouse - apply at the same or separate

First of all, you misunderstand how EU law works and how it is different from UK law. Status granted by EU law is automatic. If you meet certain conditions laid by the law, you have the relevant status. If you fail even a single condition, you do not have it. The status is granted by the law itself,...
