Second Tier 1 Extension

Second Tier 1 Extension

Hi All,

I have following questions for you.

1) At the time of my current tier 1 general visa expiry, I will complete exactly 4 years and 11 months in UK. So do I need to apply for second extension or I can apply for ILR? As for I know there is 28 days rule, but I am failing short of that by 2 days.

2) So suppose if i apply for my second tier 1 extension with my wife as dependant. we both will get visa for another 2 year. So after 1 month, I will become eligible for ILR. So do i need to apply for dependent visa again after 1 month as she will still have 1 year and 11 month left in her visa?

3) Once I get my ILR, and my wife need to extend her depedant visa, then how many years of validity she will have in her new visa? will she get 2 years visa again ?

Simple.

Apply for extention. After one month very the application to ILR .

I think you may need to provide further details to enable us understand your case better. When was your first visa stamped in your passport and when did you enter the UK? (And why do you say you are falling short by 2 days while at the same time you will have been in the UK for 4 years and 11 months? Were you already in the UK at the time of your first Tier 1 (General) approval? but then again, providing the dates will clarify this I guess.)

Assuming that you were already in the UK when your Tier 1 was approved, you can apply for ILR at least 28 days before the expiry of your current leave. If you entered the UK within 90 days of the Tier 1 visa date, there is a 90-day concession period, which means you can also apply for ILR within 28 days of expiry of current leave. However, if you entered the UK after 90 days, this is where you will need to extend your stay (and perhaps vary the application at some point if a decision is not made by the time you qualify). Of course this is also subject to you meeting the other requirements such as not having spent more than 180 days/year outside the UK during that five-year period.

Here are the exact dates:

Initial tier 1 visa: 15 Nov 2009
First entry in uk: 16 Jan 2010 (within 3 month)
Expiry : 15 Nov 2012

Tier 1 ext:
Start Date: 15 Oct 2012
Expiry Date: 15 Oct 2014

Also, I have not violated 180 days rule.

You did a mistake by taking an early extension on 15 Oct 2012. If you could have taken extension starting from 15 Nov, 12 then there would have been no need for second extension.

Unfortunately now you need to go for another extension and after 1 month i.e. by 15 Nov, 14, you will become eligible for ILR subject to all other criterion met.

Incorrect. You don't need 2nd extension unless you have a lot of money...

From Sunday, November 15, 2009
Added 4 years, 11 months, 2 days
Result: Friday, October 17, 2014

You can apply for ILR on or after Friday, October 17, 2014.

Now your leave to remain is expiring on 15 Oct 2014.

You have two options

Apply for ILR by post before 15 Oct 2014 (lets say 12 oct) and you will be safe.
Or
Apply for ILR on PEO on 17th Oct 2014 but make sure your application is perfect so you won't get rejection. Search this forum and you will find alot of cases...

Regarding second option, I am not too sure, as I will be in uk beyond my visa expiry date.

Also, can someone tell me about depedant visa in case I apply for 2nd ext. ? Do I need to apply for the dep. visa renewal again during ILR application?
