SET(O) via Tier 2 documents advice on Yes or No

Post by EpkIMQs » Tue Feb 12, 2019 1:17 pm

Hi all,

Thanks for the previous help on my successful ILR and now I am preparing my husband's Settlement application via Tier 2. I hope you could kindly review the list of documents below and let me know if these looks good. Also we still have a few questions that need confirmation, which are listed below the checklist.

My SET(O) application visa Tier 2 route is straightforward so no special evidence is required. The list below covered all the required documents listed after I completed the application form with a few additional supporting documents, please have a look:

1. A declaration signed by me to confirm my consent for the Home Office to request verification checks.
2. Passport (1x old, 1x new)
3. Police registration certificate
4. Life in the UK Test pass notification
5. Letter from current employer (Are the information sufficient?: Detailing paid annual leave; SOC; annual salary; previous salary and when my salary was increased (I met the requirement before the increase); that they still needs me)
6. Letter from previous employer detailing paid annual leave (is this ok that this is an old letter issued when I left the previous employer?)
7. MSc degree certificate for language proof
8. Evidence of immigration status (BRP?)
9. Payslip for February (one month adequate?)
10. Bank statement for February (one month adequate?)
11. Current BRP
Other planned supporting documents:
12. Marriage certificate and certified translation
13. Letter from wife with settled status
14. List of absences from the UK
15. SAR with entry records for the last 5 years - still waiting for it (is this document helpful or not necessary?)

Other questions need confirmation:

Q1: I was solely on Tier 2 for the 5 years so I guess I do not need to provide documents showing I met the relevant requirements of the immigration rules before my Tier 2 status?

Q2: Apart from what is required on the checklist, do I need to enclose any tax form or history as well (I do not have self-employment history)?

Q3: I changed employer once during the 5 years time. Do I need to provide details of previous pay and/or tax history for the previous job?

Q4: Also regarding the question asking the identity card number from my home country, I do not have this card with me now, can I ignore this question?

Q5: I had Tier 4 student visa and PSW when I firstly entered the UK in 2008, and then I left UK in 2010 and reentered in 2013 as a Tier 4 dependant of my wife, after a few months work, I got a Tier 2 visa in March 2014. Do I need to include any information about my previous immigration status (all normal without issues).

Q6: Is there anything else I shall consider to submit other than the 15 documents listed above?

Many thanks! :)

1. A declaration signed by me to confirm my consent for the Home Office to request verification checks.
2. Passport (1x old, 1x new)
3. Police registration certificate
4. Life in the UK Test pass notification
Fine. Does the form as for the police registration certificate?
5. Letter from current employer (Are the information sufficient?: Detailing paid annual leave; SOC; annual salary; previous salary and when my salary was increased (I met the requirement before the increase); that they still needs me)
Fine.
6. Letter from previous employer detailing paid annual leave (is this ok that this is an old letter issued when I left the previous employer?)
Should be ok.
7. MSc degree certificate for language proof
Is this a UK degree??
8. Evidence of immigration status (BRP?)
9. Payslip for February (one month adequate?)
10. Bank statement for February (one month adequate?)
11. Current BRP
Fine.
Other planned supporting documents:
12. Marriage certificate and certified translation
13. Letter from wife with settled status
Not required. You are not applying for ILR based on spouse visa and marriage to a settled person.
14. List of absences from the UK
Fine.
15. SAR with entry records for the last 5 years - still waiting for it (is this document helpful or not necessary?)
HO obviously have this available, no need to submit it.
Q1: I was solely on Tier 2 for the 5 years so I guess I do not need to provide documents showing I met the relevant requirements of the immigration rules before my Tier 2 status?
Nothing to add no.
Q2: Apart from what is required on the checklist, do I need to enclose any tax form or history as well (I do not have self-employment history)?
No.
Q3: I changed employer once during the 5 years time. Do I need to provide details of previous pay and/or tax history for the previous job?
No.
Q4: Also regarding the question asking the identity card number from my home country, I do not have this card with me now, can I ignore this question?
Not required. You could tick NO on the form.
Q5: I had Tier 4 student visa and PSW when I firstly entered the UK in 2008, and then I left UK in 2010 and reentered in 2013 as a Tier 4 dependant of my wife, after a few months work, I got a Tier 2 visa in March 2014. No.

No.
Thanks a lot for the reply. Yes it is a UK MSc degree and the police registration certificate is required.

For the question about marriage certificate, I wonder is it still worth mentioning as I assume it would be helpful to have a settled partner indicating my strong bond to the UK? Maybe just to mention it in the cover letter instead of submitting my marriage certificate?

Thank you.
