Settlement for Wife and Kid from India

Post by Naveen1 » Mon Jan 27, 2014 4:50 pm

Hi

Firstly apologies if the following issue has already been covered before. I tried to find relevant information browsing through the site. However, it only made me even more confused.

Scenario:

1. I am on ILR currently (Issued September 2013) through Tier 1 General.
2. Married when I was on Tier-1 General in 2012.
3. Brought my wife to UK on Tier-1 General dependent visa.
4. Wife's Tier-1 General Dependent visa expired in September 2013 as my Tier 1 General visa expired as in effect after I got my ILR.
5. Wife currently in India to give birth to our child.

Questions:
1. What Visa should I apply for my wife and kid to bring them back to UK.
2. What application forms I need to use?
3. Can I apply for child's settlement (ILE) as only one parent (myself) has the ILR? If not, what other visa can I apply?
4. If I apply for Naturalisation in September 2014, (and if my kid is still in India then), can I apply for his/her Citizenship whilst my child is in India?
5. I believe I need to just show the proof of my gross salary and do not necessarily maintain a fixed amount in my bank account. Is that correct?
6. Is there a need for TB certificate, IELTS for wife's Visa application?
7. I read Settlement visa (if this is what I have to apply) is taking quite long to process in India. Any other suggestions?

Once again I am sorry if you have already answered these questions before. But, I would greatly appreciate if you can help me please.

Thanks
Naveen

4. If I apply for Naturalisation in September 2014, (and if my kid is still in India then), can I apply for his/her Citizenship whilst my child is in India? No, child needs to be present in UK and ideally hold ILR to be able to apply under section 3(1) for registration as BC (child born abroad). Child would only be British if born in the UK to a ILR holder and could then apply directly for passport
5. I believe I need to just show the proof of my gross salary and do not necessarily maintain a fixed amount in my bank account. Is that correct? Yes, approximately £22,500 pa see link below
6. Is there a need for TB certificate, IELTS for wife's Visa application? Level A1 in English and TB cert required
7. I read Settlement visa (if this is what I have to apply) is taking quite long to process in India. Any other suggestions? It is the only visa your spouse and child qualifies for if applying as your dependents.

Or can I apply when I apply for my naturalisation in Sep 2014?]
5. I believe I need to just show the proof of my gross salary and do not necessarily maintain a fixed amount in my bank account. Is that correct? Yes, approximately £22,500 pa see link below . Thanks. Its a relief not having to maintain a specific amount in the account. The link says £22,400/annum for spouse and one child.
6. Is there a need for TB certificate, IELTS for wife's Visa application? Level A1 in English and TB cert required . [My wife did her B-tech taught in English. So, would it be OK if I submit her convocation/original degree certificate in the application?
