Skilled Worker Visa CoS duration and BRP duration do not match and visa charges

Hi,

The duration given by the home office for my skilled worker visa is not equal to 5 years, however, CoS was raised to a full 5 years. I am confused about whether I will have to extend my skilled visa to be eligible for ILR or not. Please find details below:

CoS Start Date: 2nd Oct 2023
CoS End Date: 1st Oct 2028
Skilled worker visa decision received & start date of it = 21st Nov 2023
End Date of Skilled Visa = 15th Oct 2028

The duration between the start and end date of the skilled visa is exactly 4 years, 10 months, 25 days which expires before the earliest ILR application date of 28 days.

Do the dates look fine? Should I go for an administrative review as I might not be eligible to apply for an ILR? Can someone please clarify?

The start date us alwasy the date of decision. It is not backdated to the cos start date. The end date is alwasy 14 days after cos end date.

What date did you apply online and what date did you enroll Biometrics?

Admin review is if ukvi made a mistake, which they have not.

I applied for Skilled Worker on 20th September 2023 under Priority (decision within 7 days) but due to a mistake of putting my job role in shortage occupation as was mentioned in CoS delayed my decision to a normal standard processing time of 8 weeks.

Application date: 20th Sep 2023
Biometric enrolled: 20th Sep 2023 using ID check Biometric App
Home office Response regarding extra payment for a job role not in shortage occupation: 25th Sep 2023
Replied to the Home office with my card details: 26th Sep 2023
Extra Payment deducted: 13th Nov 2023
Decision received: 21st Nov 2023

Can you please suggest? Am I eligible to apply for ILR ? or what can be alternatives in this case? Should I think of changing my job to another employer after some years to apply for new visa and get a new end date ?

You have only just started your immigration journey and presumably only arrived in the UK this week!! No one can tell you what the rules will be in 5 years time, they change often.

Focus on the now and getting through the next 5 years and ask ILR questions nearer the time.

Also remember that the Home Office will not accommodate the duration of the leave to make time for the applicant to be eligible for ILR, it doesn't work that way. For a reason some applicants have that false perception.

The Skilled worker route is just one of those that make an individual eligible for ILR as long as the other requirements are met. The HO don't assume that every worker coming to the UK must or will apply for ILR in the future.

The decision you received is correct.

Thanks for clarification. I also think now that decision is correct and its better to start the fresh journey and think for ILR later, as rules might change.
