Skilled Worker Visa Validity

Post by brilliantlyradiating » Mon Aug 28, 2023 3:49 am

Dear Admin,
I am seeking advice on my visa validity dates. I have been granted a skilled worker visa valid from 31 July 2023 until 15 June 2028 as per the letter received from the home office. This is making 45 days less than the 5 year requirement mark for the ILR.
Please advise what can be done. I have also entered the U.K a week ago.

Thanks

The work dates are 02 June 2023 and 01 June 2028. Then there is a sponsor note that start date is 15 Aug 2023. Looks like the employer forgot to mention the new end date in the note in accordance to change in start date.
Please advise the way forward.
* Can anything be done now.
* Or it can only be done at the time of visa expiry
* Will I have to apply for visa extension for 3 years to cover this 45 days gap to reach the 5 year mark
* Or will I be able to apply for ILR 45 prior to 5 years criteria.

Thank You

Can apply before the expiration however it will leave you to fix your appointment on later date if current requirements and guidance stays same till then.

Sorry I have not understood your point clearly.
You mean I can apply 45 days before reaching 5 years? If so, will I directly apply for ILR without any extra cost or process.
Please if can elaborate in simple terms.

Thank you so much for your response

Then your visa expiry date is correct. 1st June 2028 plus 14 days.

Adding a sponsor note regarding work start date has nothing to do with the end date of the CoS period. Two separate things. Adjusting the work start date in the sponsor note (not the CoS start date), does not change the CoS end date.

In this whole scenario, my visa start date is 31 July 2023 and end date is 15 June 2028. In this case, what will I do when I reach the expiry of my visa because I will be short of 45 days.

What are my options now?
Or what will be my options then?

Thank You

Your visa is already approved, you cannot do anything now. The validity of your current leave is correct as advised before. The dates will be updated accordingly when you make another application at any point in the future.

Remember that the CoS is not issued to fit the applicant's time for ILR! The Home Office (or your employer) will not accommodate the dates to fit that!

You're five years away from ILR, anything can happen along these years, the immigration rules are constantly changing. Also there will be general elections in the UK next year and the immigration system is one of the main topics within the politician campaigns, it's very likely that changes will come!

What if you change jobs? or you change your visa type? or the rules change and you don't qualify at all for ILR in 2028 but later (or before)?

So many things can happen and your options in five years will be based on what will be available then!
