Sponsorship license

Hi,

We are a retail company applied for sponsorship license in September 2018. We got home office letter that our application has been rejected for the following reasons.

"You have not supplied the mandatory documentation listed in App A.In this case you have not provided full answers to all of the questions regarding the business and requested CoS, as listed below and on pages 3-4 of appendix A."

We haven't seen any of these questions while processing the questions.

Could someone advise if these will appear as questions on the application form?

Do they just refer the mandatory documentation to the unanswered questions?

Is there any enquiry line to get further details about this application rejection?

Did you submit the mandatory documents listed in Appendix A?

Did you answer in detail the questions in Appendix A, on page 3 and 4?? You would have needed to answer these separately to the application form, this is in addition to ALL the mandatory documents you must submit.

The documents we submitted were :

1. There was a section saying "the following documents must be sent if they are applicable to your type of Organisation:

a) We submitted "Audited annual accounts". That was the only thing applicable to our organisation type

2. The second section was "You may send any of the following documents in support of your application"

We submitted:

a) Employer's liability Insurance Cert
b) HMRC Reg- VAT
c) HMRC Reg-PAYE Ref No/Acc Ref No
d) Proof of Bus Prem/Fxd Assets/Lease
e) Business Bank statement

But, we did not see any questions in Appendix A, on page 3 & 4 on the online application form. There was a section "CoS and CAS", under that they asked, "Reasons required: please provide as much detail why you need the requested allocation". That's the only thing we saw while processing the online application form.

Could you please advise these questions are there on the online application form?

What is your 'organisation type' and on which page of Appendix A does it appear~?

You likely have to write a justification addressing each question on page 3/4 of Appendix A, as a separate 'supporting document'.

We don't fit in any category they mentioned on Appendix A page 5 to 16.

We have chosen "Wholesale & Retail Trade;" on the application form. The business activity description on our VAT certificate is " Other retail sale of new goods in specialised stores"

Apparently, we missed out all the questions from page 3-4 on Appendix A.

What I understand now is there will not be any questions(page 3-4 appendix A) to answer on the online application form, instead, we need to write a justification addressing each question on page 3/4 of Appendix A, as a separate 'supporting document' and send it to home office while sending the printed application form and other supporting documents. Could you please advise if I understood this correctly?

Also, could you please advise we address the 3/4 Appendix A questions on a company headed paper, signed by the issuing officer and send as a separate supporting document?

Correct. You will also need to provide the documents stated on page 3 and 4 of the Appendix, ie list of all employees including job titles, recruitment process and job adverts etc.

Presumably you are apply for a Tier 2 GENERAL sponsor licence?

What job and SOC specifically are you hoping to sponsor a person for??

Yes, we apply for Tier 2 General. Sorry for not mentioning that earlier. We conducted RLMT.

We now need to issue 1 CoS; Job title is Database developer - 2136.


The person we identified is not currently working for us. I understand we need to address the candidate's full name, date of birth, nationality, current immigration status, current job title and duties. Do we need to submit the below documents also?

1. candidate's CV
2. Candidate's 3 months payslip

Are there any other candidate's documents we need to submit?

Could you also please advise if " recruitment process" refer to the below:

1. The job adverts
2. A description of how many applications we got and why we couldn't consider others
3. The interview invitation we sent for the potential candidate

Did you only interview one person, the one you wish to sponsor??

What visa does this person currently hold?

2136 is one of the more abused SOC as well, so your evidence of 'no other person suitable' needs to be rock solid.

Hi,

No interviewed other candidates also and we have strong and genuine reasons and proofs for not considering others.

Could you please advise if the documents mentioned in the previous reply are enough?
