Spouse to ILR query

Post by ruzfactor » Wed Mar 04, 2020 1:38 pm

My question is also related to Spouse to ILR.

I am eligible for ILR (Long Residence route) August this year. However, my wife's 10 year continuous residence would be in 13 August 2023 (entry to UK). Our current visa (TIER2 General and TIER2 Dependent) expires on 16 January 2021. If I go for LR route, she will have to apply for FLR(M) which is initially granted for 2.5 years. Although her ILR resets, I am assuming she is still eligible for ILR in 2023 (LR).

Now, I am seeking suggestion on the following scenario:

If she gets a FLR(M) until 17 July, 2023, she can apply for ILR within that FLR(M) period.

Will that be wise enough to submit FLR(m) application on 15th January, 2021 and delay the biometric (go for standard service)? If that's ok, how long can that be delayed?

Thanks.

You are expected to submit your biometric within 40 days from submission.

It could be a good idea but risky. though within standard service, I believe it takes roughly over 2 months before the application is reviewed. however this is significant risk too.

In her case even if she gets the decision on 15th January 2021 then will be given 30 months of leave which will stretch her stay until 15th July 2023 which will almost enable her to proceed to set (lr) because you can apply 28 days before completing 10 years.

Thank you for the reply. I assume the 30 months will be from the date the decision is made not the submission date?
