Spouse Visa (After PR)

Hi All,

I have heard good comments about this forum and i hope you will be able to put me in the right direction.

Can i apply for visa for my spouse after receiving PR through EEA? I was a non -EEA before but i have divorced my first husband.

What is the requirement needed to qualify for this? Do i have to earn certain salary per annum to qualify?

Yes it does, but you need to give more information about your specific situation. Have you already married and is your spouse currently in the UK on a visa?

Does your spouse have a valid visa at present? If not, he won't be able to apply to switch to a spouse visa within the UK and will have to apply from his home country for entry clearance.

No my spouse doesn't have a valid visa now but an application is with HO but we are contemplating if we should withdraw that and apply on this ground. Please let me know the type of visa my spouse will get if we use this route.

He won't qualify for a visa in the UK. As CR001 has advised, he will have to return to his home country and apply for a spouse visa from there. If successful he will be issued with a 30 month visa, giving 30 months limited leave to remain. The visa fee is £956 and he will have to pay the £600 NHS surcharge.
A1 level pre-entry English test also required.
What application is currently with the Home Office awaiting a decision? Do you have any children together?
