spouse visa ending but she has not been working, is this ok?

Post by nickolase » Wed May 12, 2010 12:08 am

Hello: )
My wife came here from the U.S.A. after we were married there, I have been on disability living allowance (lower rate) for some years for mental health and income support of course.

After she got here she got a job and because of my benefits situation and her immigration control the benefits agency made a special decision that we may not be allowed any disregard (usually £20) so what happened was we lost almost all the housing benefit and income support when she quit her job and her earnings were deducted from my income.

Since then we decided that life would be a lot safer if she didn't work because we didn't want to lose our flat and she is only qualified for minimum wage jobs.

Has this happened with anyone else?
The visa runs out in November and she is petrified of being sent back to America where she has nowhere to go, and of losing me.

Does she need a job as soon as possible? Any job? Because the Citizen's Advice Bureau told us that it would be better if I got a job and we have been working towards that, I have even been volunteering to get references for my CV.

Does anyone have any idea what will happen and what to do next? Should we both try get any job going? Or continue to find me a tech job and her a regular job until November?

Basically how important is the rule about both of us being not dependent on state benefits and what does it mean when pertaining to our situation?

Many many thanks.
