Spouse visa extension help

Post by marleyjane » Mon Nov 02, 2020 11:18 am

Hello everyone,

I am hoping to get some guidance on renewing my Spouse/ Partner Leave to Remain visa that expires early next year.

Here is a little bit about my current situation. As mentioned above I am currently living in the England with my husband on the Spouse/ Partner Leave to Remain (2.5 year one) visa that is due to expire soon. I need to extend this visa as I still haven’t been in England long enough to apply for my Citizenship.

A few years ago I remember coming across a very helpful check list of all the documents/ information that was required in the visa application but I cannot seem to find it now. Can anyone provide me with this check list please?

For proof of our marriage we have the marriage certificate plus we live together – can provide tenancy agreement with both of our names as well as official mail addressed to both of us. How many pieced of mail do I need to provide?

For the financial requirements, do I need include my husband’s income information in our application as I myself meet the financial requirement with my current employment? Also does anyone have the information in which my employer needs to confirm in the letter I need to include in my application (i.e. employment status, current pay ect).

Thanks advance for any help

You will need 6 piece of documents if jointly addressed otherwise (sole named) 12 in each name or mix n match from at least 3 sources covering the last 2 years with even gaps of 3-4 months. Tenancy agreement can also be utilized as one of the document for this purpose.

Whoever is earning sufficiently and able to produce the necessary documents such as 6 or 12 months of payslips, corresponding bank statements and employer letter under category A or B respectively can use his/her income alone without declaring the other partner's income. Your employer letter must provide the key information such as your annual income, length of service, contract type, job title etc.

Thanks so much for that.

One more query regarding the financial proof. My employer currently issues payslips electronically. In their covering letter can they address this and will that be sufficient?

Yes, they should state that the payslips are genuine.

If they wish then can confirm its authenticity despite it wouldn't be pacifically needed where the payslips are replica of original.

Thanks for all the help.

This is the letter my workplace has provided me:

Dear Sir/Madam,
Re: Marlene (SURNAME) – DOB: ****
I write to confirm that the (WORK PLACE) has employed the above
individual since 3rd November 2018 until present as a (JOB ROLE).
Furthermore, I can also confirm that her employment type is permanent and the annual basic salary
is (SALARY) per annum. This salary was revised effective from 1st April 2020, and I can confirm
that Marlene’s pay slips are genuine.
The details in this letter are provided in order to support Marlene (SURNAME) request for Visa
Application. This letter is provided in good faith and in the strictest of confidence. Care has been
taken to ensure its accuracy but it is supplied without legal responsibility.
Please do not hesitate to contact me on(CONTACT NUMBER) if you have any queries.
Yours sincerely
(HR OFFICER)

Would this be sufficient? Also due to COVID we are all working from home due to government guidelines. That being said this letter was provided to me electronically - it is headed and has my HR officers electronic signature. Would this be accepted during the current pandemic circumstances?

Sorry for all the questions, and thanks again in advance for any advice.

I have another question regarding mail in both our names. I was only able to find the following pieces of mail in both of our names:

- 6th June 2018 - Tenancy agreement lasting until 22nd May 2019
- 4th September 2018 - Letter from Bank
- 6th October 2018 - Water bill
- 12th February 2019 - Council Tax
- April 3rd 2019 - Water bill
- 25th April 2019 - Letter from home insurance agency
- May 9th 2019 - Council Tax
- 16th October 2019 - Water bill
- 16th January 2020 - Letter from Bank
- 9th March 2020 - Council Tax
- 18th June 2020 - Water bill
- 3rd July 2020 - Council Tax

I am aware that there are a few gaps in there but I don't have any mail correspondence addressed to both of us. I know we are due a water bill very soon so I am hoping I will be getting that very soon which will cover November 2020.

In the areas where there are a few bigger gaps, could I include letters that were addressed to us individually?

Yes, you can and it should be fine. Use what you can lay your hands on to plug as much gaps as you can.

These seems outside of the remit of last 2 years assuming you will apply during the month of November or onward.

Yes I will be applying in November. Do I only need to provide letters from the last two years? I wasn't sure if I had to provide documents dating back to when I was issued my visa on the 08/06/2018?

Better to not provide anything which is irrelevant.

Hi me again with another question...

For the question "Have you been out of the UK since you started living here?" do I need to include every time I have left the country to go on holiday since I've been living in the UK?

I have lived in the UK continuously since I came here on a student visa almost 6 years ago and then switched to spouse visa in June 2018. My husband and I have been out of the country several times to go on holiday bit have never been out of the country for more than 2 weeks at a time.

Pretty self explanatory question which is simply asking the absence from UK which should be provided for the duration of spouse visa/Flrm which won't have any affect because of no threshold for it.
