Spouse Visa Extension or ILR

Post by fimran » Thu Apr 04, 2019 7:44 pm

Hi Guys,

Can someone please answer this question. is this going to be another extension or eligible for the ILR .
My mrs application as a partner

2 years, 9 months excluding the end date ( 19/03/2014 - 19/12/2016 ) - 33 months
2 years, 6 months excluding the end date ( 19/12/2016 - 19/06/2019 ) - 30 months
she arrived on Aug 23rd 2014 which is after 5 months, 4 days after visa issued. she will be completing the 5 years on Aug 23rd 2019 if i start calculating from the date of arrival. now that her visa is going to expire on 19th June 2019 do we need to do another extension or does she can apply for the ILR ? also if its extension what form should we use for the spouse visa extension.

Thanks

She will need another extension to cover the shortfall.

Her ILR qualifying period starts from the date she entered the UK and by delaying her entry by so long, she now has this issue.

She can apply for ILR no sooner than within 28 days before the 5th anniversary of her entry date.

Form FLR(M) for extension, same as she used for last extension. A2 English required and same financial requirements. She will also have to pay the visa fee and the IHS fee of £1000.
