Spouse visa extention cannot meet financial requirement

Post by carlosvr6 » Tue Sep 15, 2015 6:59 am

My wife is currently in the UK on a spouse visa 5 yr route, current her visa is up for her extension after 2.5 yrs for an FLR extention unfortunalty due to my circumstances I will not meet the financial requirement, we have 2 children both British citizens holding UK passports, what are my options as her flr visa would be refused, our kids are currently in school thus her having to leaving will be devastating for the kids

Do you work at all?

Does your spouse work?

Yes currently I am working, my wife is not, however I am currently on a 20k salary and have been so for the past 2 months unfortunately the visa is due for renewal in a months time, thus I require another 3-4 months of work in my current job to meet the financial requirement

Did you work before your current job and if so, what was your salary?

The Option will be open to you to apply under FLR(FP) and then varying the application to FLR(M) if a decision is not made after you have maintained 6 months of employment.

In any event, I believe the FLR(FP) should succeed.

Thank you for all the help :D
If we decide to go down the FLR fp route and the visa was successful, can I apply to switch the visa to a FLR m once I have met the financial requirement in 4 months time, would I have to pay for the fee again to do this if it was possible?. The reason being, currently I'm on the 5 year route for the ILR, my understanding is on the FLR fp I would have be on the 10 year route for the ILR thus the switch may help me save time to apply for her ILR

Once again thank you

Sorry if that was confusing, if we vary the visa from FLR fp to FLR m would the cost be the standard fee for another FLR application, and the question I asked about the route was I'm currently on a 5 yr route if I take the FLR fp would I still be on the 5 year route?

FLR(FP) would put you on a 10 year route to settlement, but once you meet the financial requirement you could vary to FLR(M) - back on the 5 year route. It would be a standard fee for both.
