Spouse Visa Refusal

I know someone who married a UK citizen who is on benefits owing to ill health. They applied for a spouse visa under human rights and it was refused. They have appealed and the decision to refuse was upheld. Now the Home Office are asking for the spouse to leave the country and make an out-of-country application. Has anyone had experience of this on how to tackle this - to make an in-country application?
