UK Spouse Visa Renewal - 2015 Rules

Post by srcom » Thu Aug 27, 2015 1:48 am

Hi all,

My wifes Visa is up for renewal in October 2015. I have been searching around this and many other forums and some of the information is contradicting or do not fully match our circumstances so hoping someone can help here...

The key information is as follows:

[*] Spouse Visa renewal
[*] Current visa dates = Jan 2013 to Oct 2015
[*] She is from Bangladesh
[*] It will be her first renewal after just over 2.5 yrs

She will be applying to extend her visa, I'm assuming it will be an FLR(M) to take her up to 5 years before we apply ILR.

So the questions are:

[*] Does she need to do anything other than a B1 language test?
[*] Does she need to do Life in the UK?
[*] Our son was born in the UK (9 months old) does he need to be included in the application?
[*] We only have a bank account in joint name, how else do we prove the living together / relationship criteria?

Many thanks in advance.

Posting in early hours of the morning twice within minutes is hardly likely to get a response. Please be patient.
[*] Does she need to do anything other than a B1 language test? She needs A1, but B1 is acceptable.
[*] Does she need to do Life in the UK? No, this is required for ILR, not FLR(M) extension
[*] Our son was born in the UK (9 months old) does he need to be included in the application? If the child is British, then no, but you should mention the child.
[*] We only have a bank account in joint name, how else do we prove the living together / relationship criteria? Please read the FLR(M) form, it does list examples of what is accepted. It can be in joint or singular names.

Hi,

Thank you for the response, much appreciated.

Do you know if she can life in the UK at any time and use it when she needs in future? Or does it expire after a period of time?

Also the posts are a day apart... Not minutes :) but I can see why it looks that way.

The LIUK test doesn't have an expiry date.

Hello again,

We've just been looking at the application form and have a few more questions - hope you can help...

In regards to proving that we live together, we only have a joint bank account at our address. We live with relatives so didn't have any utility bills or anything else in our names. I have my work payslips and mobile phone bills at this address but none of these have my wifes name (the applicant)... her phone is also registered in my name.

Do you think this will be an issue?

The bank statements spread over 2 years. She has a couple of other letters, one from GP and I think one other from a hospital. But nothing else.

Everything else (financial / language test etc.) is in good order, but we're really worried about the address thing - not sure how else we will be able to prove we've lived together.

The FLR(M) form says:
If you and your partner lived with relatives or friends for some or all of the 2-year period, please
provide a letter from the relative(s) and/or friend(s) confirming this.

and
Please give an explanation on a separate sheet if you cannot provide six items; if the items are
not addressed to both of you; or if they do not cover the 2-year period
