Spouse Visa Renewal

Post by britian » Mon Oct 01, 2018 6:30 pm

Hi all. Thanks for advice in the past, everything is going well.

Background: I work in Nigeria on rotation (6 weeks on, 2 weeks off) and my wife is currently in the UK with our 2 daughters (3 & 1yo). Married April 2015. 2 x Visitor Visa and a spouse visa.

Her spouse visa is up for renewal in January 2019 she has had it since April 2016.

The oil business has been tough this past few years, so I was doing extended rotations, thinking it might be my last, so my wife spent a few months with me, as such, she certainly hasn't stuck to the 90 day rule, though she has done the last 11 months in the UK straight, since the birth of our second and our first starting nursery.

My question is what visa should she apply for next and can she apply in the UK? Would we be able to get Indefinite Leave To Remain, or should we go for another spouse visa?

For the record, both daughter's are British citizens and I am from birth.

Thanks

For spouse visa extension apart of others requirements meeting financial requirement & 2 years of cohabitation is very imperative. So ask yourself that how will you meet these?

Should I be going for a spouse visa extension then?

I earn well over the threshold and we all live in the house I bought in the UK.

There's not really any limit for time spent abroad on Spouse visa, but when it comes to citizenship your abroad days may be an issue. Just do the Further Leave to Remain Application to extend the Spouse Visa.

I need some more advice. We applied using FLR (M) but my wife got put on the 10 year route due to not doing the A2 English test. I just submitted the previous SELT pass from last time, so an oversight from my part. Her English is perfectly fine, so I have no concerns with her passing. I'm a bit annoyed because I paid extra for document checking too, but nevermind.

Can we take the English test and reapply, we meet all financial and housing/support requirements.

Will the 5 year route "reset" or will her previous visa in the UK count?
