Spouse Visa switch to ILR

Post by JamranHasan » Mon Sep 18, 2023 4:47 pm

Applicant is currently on spouse visa and her Current Visa expiring 26 Feb 24. She is eligible to apply for ILR.
Her Sponsor is Self employed and can’t declare income till 05 April 23 and YE 2022 does not meet income Threshold.
What could be the option ?

Did you intend to post the date of 05 April 2024?

I seem to be missing something here. He can't declare income until 05 April 2023, which has already passed. The HO Case Worker will want to see income for the tax year April 2022 - April 2023. i.e the last tax year prior to the ILR application date.

Does he meet the income level for tax year 2022-2023 :?:

Rephrasing the query again:

Her Sponsor is Self employed and can’t declare income till 05 April 24 and YE 2022-2023 does not meet income Threshold. He doesn't meet the income level for tax year 2022-2023

If you don't meet the financial requirements, she won't be able to apply for ILR, it will be refused and she will be notified to pay IHS and put on the 10 year FLR(FP) visa route.
