Status of Tier 2 dependents after primary applicant gets ILR and changes the job

Post by rd350 » Tue Nov 20, 2018 7:33 pm

Dear forum

I hope you guys can help me with this .
I will be eligible for ILR in Dec'18 after having been on Tier 2 PBS for 5 years. I have an existing Tier 2 covering me and my dependents till August '19. However my dependents will be eligible for ILR in March'19.

Now I am due for a career progression and that can happen if I move jobs. If I take up ILR in Dec'18 and move jobs in Jan/ Feb'19, can my dependents continue on the same Tier 2 dependent visa till August'19?
Truth be told, I will not wait for August'19 to get my dependents their own ILR. But I would need breathing space to get the funds sorted as am planning for premium application.

Disclaimer- I have looked through the web and archives, but couldn't find a similar situation that answers my query. If I have duplicated the question, please feel free to point me to the webpage.

Regards
RD

Yes they can. The rules permit this if you apply for ILR based on 5 years PBS route. Note rules are different for dependents if you apply for ILR based on long residence,

Thank you CR001. That's very helpful.

Am I right in saying that my dependents can continue in their pre-existing Tier 2 dependent visa till August'19 even after I change job following my ILR?
Sorry if I am repeating myself but hope you can understand the anxiety around these.
